1. The issues under consideration i.e. the reliefs sought by the complainant in the complaint dated 21.08.2019 due to alleged non-supply of information vide RTI application dated 12.06.2019 are as under:-

(i) To impose penalty on the concerned CPIO as per section 20 (1) & (2) of the RTI Act.

(ii) To provide all the requisite information as the earliest.

2. Succinctly facts of the case are that the complainant filed an application dated 12.06.2019 under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Bank of Baroda (erstwhile Vijaya Bank), Mysore, seeking following information:

Certified copies of folowing documents pertaining to the complainant’s loan Account No.: *************067:-

(i) List of holidays of your esteemed Bank & Branch for the period 01.01.2019 to 31.03.2019.

(ii) Copy of the loan sanction letters (also 29.12.2016)/Legal Opinion Report/ Valuation Report/ Building & Property insurance copy issued to our above said firm and loan account and schedule properties situated at Banni Mantap and Nazarhabad Mohalla, Mysore along with terms and conditions & acknowledgement of receipt of the same.

(iii) Copy of loan disbursement written request submitted by borrower/ guarantor to your bank and branch and the models of loan amount disbursal at the time of availing the loan.

(iv) Copy of the registered Mortgage & Deposit of title deeds, annexure-II and Hypothecation Agreement of Furniture and other Fixtures and valuation copy of the movable items same along with acknowledgment of receipt of the same executed by Borrower & Guarantors pertaining to said Account and property.

(v) Copy of the statement of account from the date of sanction till date.

(vi) Copy of the details of renewal of account for the period 31.03.2016 till dated along with details of processing charges for same. If done on which date, and if not done the reasons stated for the same which is duly entered in the concerned Registers of Bank and Branch.

(vii) Copy of the audited Balance Sheet for the period 31.03.2018 to 30.05.2019 stating our account’s as NPA and memorandum of interest account details and rate of interest charged form date of NPA till date.

(viii) Copies of all the entries made & reasons mentioned in the concerned NPA register and other registers under which category the account is classified as NPA and copies of all the correspondences along with acknowledgement of receipt of the same between the branch and the regional office, Mysore regarding classification of Account as NPA.

(ix) Copy of the loan recall notices issued if any, against our said account along with copies of all entries made in the concerned registers & dispatch register along with copies of postal receipts regarding issuance of the same along with acknowledgement of receipt of the same.

(x) Copies of the demand notice and all the entries made in the concerned dispatch register regarding issuance of demand notice u/s 13(2) of the SARFAESI Act dated 01.10.2018 to borrower & guarantors along with copies of postal receipts and acknowledgement of receipt of the same.

(xi) Copies of all the correspondences along with acknowledgement of receipt of same between the branch, regional office and the security agency regarding appointing the security agency towards the said properties/ items of the borrower/ guarantor.

(xii) Copy of possession notices along with copies of all the entries made in the concerned dispatch register regarding issuance of possession notice u/s 13(4) of the SARFAESI Act dated 03.12.2008 along with acknowledgement of receipt of the same. And photograph copies of affixing Possession notice & publication of possession notice in newspapers dated 03.12.2018.

(xiii) Copies of all the correspondences between the branch, circle and regional office, Mysore & authorized officer & valuator for the period 2017 till date regarding seeking valuation of mortgaged (both movable & immovable) properties and hypothecated items along w
