Information sought:

The Appellant filed an RTI Application dated 18.09.2019 seeking information on the following four points:

Shri Manoj Kumar, APIO/RPF/HQrs./Northern Railway, New Delhi vide letter dated 30.09.2019, transferred the RTI Application u/s 6(3) of the RTI Act to the PIO, ASC/P/RPF, East Coast Railway, Bhubaneswar and endorsed a copy of the same to the Dy. GM Law-cum-Public Information Officer, Baroda House, New Delhi as well as to the Appellant.

The CPIO/Personnel, Headquarters Office, Northern Railway, Baroda House, New Delhi vide letter dated 07.10.2019, transferred the RTI Application u/s 6(3) of the RTI Act to the CPIO/RPF, Baroda House, New Delhi and endorsed a copy of the same to the Appellant.

Shri Manoj Kumar, APIO/RPF/HQrs./Northern Railway, Baroda House, New Delhi vide letter dated 14.10.2019, transferred the RTI application u/s 6(3) of the RTI Act to the PIO, ASC/P/RPF, East Coast Railway, Bhubaneswar and endorsed a copy of the same to the Chief Public Relation’s Officer/PRO/State Entry Road, New Delhi as well as to the Appellant.

Being dissatisfied, the appellant filed a First Appeal dated 02.12.2019, which has not been adjudicated by the First Appellate Authority as per available records.

Grounds for Second Appeal:

The Appellant filed a Second Appeal u/s 19 of the Act on the ground of non-

receipt of information from the Respondent.

Submissions made by Appellant and Respondent during Hearing:

The Appellant stated that he has not received any information from the Respondent till date.

Shri Rajeev Kumar submitted that available information has been provided to the concerned authority/official of the East Coast Railway.

Shri Ravindranath reiterated the contents of the written submission dated 20.12.2021. He submitted that a copy of the same has also been sent to the Appellant through speed post as well as on his email address.

Decision Upon perusal of the facts on record as well as on the basis of the proceedings during the hearing, the Commission observes that appropriate reply has been provided by the Respondent and the same is upheld. The Commission finds no further scope of intervention in the instant matter.

With the above observations, the instant Second Appeal is disposed of.

Copy of the decision be provided free of cost to the parties.

The Appeal, hereby, stands disposed of.
