CENTRAL INFORMATION COMMISSION
ANANDI RAMALINGAM, Commissioner
Badri Lal Teli – Appellant
Versus
CPIO: Kendriya Vidyalaya Sangathan, Jaipur – Respondent
Second Appeal No. CIC/KVSAN/A/2023/627772
RTI Act does not require public authorities to provide opinions, clarifications, inferences, or advice beyond material in records.
Headnote:First Paragraph: The appellant sought copies of delegation letters under Para 12 of KVS Transfer Guidelines 2021 and clarification on powers delegated to Deputy Commissioner KVS RO Jaipur for teacher transfers in 2023. CPIO provided information on delegation via Office Order dated 24/01/2012 for specific grounds like posting after leave and administrative transfers. The Commission found the RTI query sought clarification and opinion, not falling within 'information' under S.2(f) of RTI Act, 2005. Second Paragraph: Key issue was whether the CPIO's response adequately addressed the RTI points. The Commission's ratio, citing Supreme Court in CBSE v. Aditya Bandopadhyay, held public authorities need not furnish information requiring inferences, assumptions, advice, or opinions, limited to material in records. Last Paragraph: The appeal is dismissed.
