1. The issue under consideration arising out of the second appeal dated 12.11.2020 include non-receipt of the following information sought by the appellant through the RTI application dated 15.07.2020 and first appeal dated 17.09.2020:-

(i) हमारा िनबंिधत डाक प(cid:1) (cid:3)दनांक ०९.०७.२०२० के आलोक म(cid:14) क(cid:15) गयी कायव(cid:19) ाही से मुझे अवगत कराएं |

(ii) हमारा िनबंिधत डाक पा(cid:1) (cid:3)दनांक ०९.०७.२०२० के आलोक म(cid:14) अगर कोई जाँच (cid:3)कया /कराया गया

हो तो उसक(cid:15) जाँच &ितवेदन क(cid:15) &ित उपल’ध कराई जाये |

(iii) शाखा थरथरी (So II D) का November २०१७ से June २०१८ तक के उपि(थित पंजी क(cid:15)

&मािणत &ित उपल’ध कराई जाये |

(iv) +ी नवल (cid:3)कशोर &साद वमा(cid:19) user ID -३०१०४९ का November २०१७ से June २०१८ तक (cid:3)कस शाखा/काय(cid:19)लय (So IID) म(cid:14) login एवं logout .आ ह,ै के पूण (cid:19) िववरण क(cid:15) &मािणत &ित उपल’ध कराई जाये |

(v) +ी नवल (cid:3)कशोर &साद वमा(cid:19) user ID -३०१०४९ का (cid:3)दनांक ०१.०४.२०१६ से ३१.०३.२०१९ तक के (था1तरण /पद (थापना आदशे क(cid:15) &ित/िववरण उपल’ध कराइ जाये |

Succinctly facts of the case are that the appellant filed an application dated 15.07.2020 under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Dakshin Bihar Gramin Bank, Patna, seeking aforesaid information. The CPIO vide letter dated 17.08.2020 replied to the appellant. Aggrieved by the same, the appellant filed first appeal dated 17.09.2020. The First Appellate Authority (FAA) vide order dated 03.10.2020 disposed of the first appeal. Aggrieved by that, the appellant filed second appeal dated 12.11.2020 before the Commission which is under consideration.

3. The appellant has filed the instant appeal dated 12.11.2020 inter alia on the grounds that reply given by the CPIO was not satisfactory. The appellant requested the Commission to direct the CPIO to provide the complete information and take necessary action as per Section 20 (1) of the RTI Act.

4. The CPIO replied vide letter dated 17.08.2020 and the same is reproduced as under:-

ii) मांगी गयी सूचना आपसे स6बंिधत नह7 ह ै फल(व9प, सूचना के अिधकार अिधिनयम ८(१) (J) के

अंतग(cid:19)त छूट क(cid:15) +ेणी म(cid:14) आता ह ै |

iii) मांगी गयी सूचना आपसे स6बंिधत नह7 ह ै फल(व9प, सूचना के अिधकार अिधिनयम ८(१) (J) के

अंतग(cid:19)त छूट क(cid:15) +ेणी म(cid:14) आता ह ै |

iv) मांगी गयी सूचना आपसे स6बंिधत नह7 ह ै फल(व9प, सूचना के अिधकार अिधिनयम ८(१) (J) के

अंतग(cid:19)त छूट क(cid:15) +ेणी म(cid:14) आता ह ै |

v) मांगी गयी सूचना आपसे स6बंिधत नह7 ह ै फल(व9प, सूचना के अिधकार अिधिनयम ८(१) (J) के

अंतग(cid:19)त छूट क(cid:15) +ेणी म(cid:14) आता ह ै |”

The FAA vide order dated 03.10.2020 agreed to the reply given by the CPIO.

5. The appellant and on behalf of the respondent Shri A K Ganguly, General Manager, Dakshin Bihar Gramin Bank, Patna, attended the hearing through video conference.

5.1. The appellant inter alia submitted that on point no. 1 and 2 of the RTI application he sought information regarding action taken on his complaint dated 09.06.2020. However, the respondent had neither provided copy of action taken report nor copy of the investigation report. He further submitted that on point no. 3, he sought copy of the attendance register of particular branch which was arbitrarily denied on the ground of third party information. Further, he stated that on point nos. 4 and 5 of the RTI application, he sought login and log out details as well as copy of transfer application of an employee of the bank. He stated that employee of the bank was public servant and information relating to the transfer of employee did not fall within the personal information of that employee. Accordingly, he requested the Commission to direct the respondent to provide the information.

5.2. The respondent while defending their case inter alia submitted that information sought pertained to third party information, disclosure of which had no relationship to any public activity
