1. As the information sought by the complainantin file nos. CIC/BKOIN/C/2022/1933, CIC/BKOIN/C/2022/661929 and CIC/BKOIN/C/2022/661931 was substantially the same, it was felt desirable to pass a common order in all the three cases.

1.2. The issue under consideration i.e. the reliefs sought by the complainant in the complaints dated 07.11.2022 due to alleged non-supply of information vide RTI application dated 19.04.2022are as under:- (i) “To set aside the order of the CPIO and First Appellate Authority and to direct the CPIO to provide the information as sought in the RTI applications dated

19.04.2022.

(ii) To award compensation to the complainant for the delay caused by the CPIO in providing the information.

(iii) To penalize the CPIO, First Appellate Authority and for withholding/concealing the information arbitrarily”.

2. Succinctly facts of the case are that the complainant filed applications dated 19.04.2022 under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Bank of India, Nagpur, seeking following information:

Kumudini Narendra Mishra and Ms. Ayushi @ Deepshikha Deepak Mishra maintained with your branch.

 The Current status.

 Amount in all the accounts.

 The statement of accounts from 2005 till date  If at all the accounts existed but have been closed please provide the reason for closure, the amount in the bank account at the time of closure, how were the funds mobilized at the time of closure of bank account, if the funds were given to the nominee please provide the name and other details of the nominee who withdrew the funds, bank account to which the funds were transferred at the time of closure of the account and all the other details related to the closure of the account and all the details regarding the transfer of funds (i) Details (as specified in above point) of any kind (saving/current/PGMY or any other)

of bank accounts in the name of Late Mr. Deepak Narendra Mishra or in which he was a nominee.

(ii) Details (as specified above) of any kind (saving/current/PGMY or any other) of bank accounts in the name of MrsKumudiniNarendra Mishra (applicant’s grandmother and mother of Late Mr. Deepak Narendra Mishra) or in which she is a nominee.

(iii) Details (as specified above) of any kind (saving/current/PGMY or any other) type of bank accounts in the name of Late Mr. Deepak Narendra Mishra’s companies viz ‘M/s Blue flame traders’, ‘M/s Sai Construction, “M/s Sai Motors, HotelSaurabh International – Nagpur etc.

(iv) Details (as specified above) of any kind (saving/current/PGMY or any other) type of bank accounts in the name of Ms. Ayushi @ Deepshikha Deepak Mishra or in which she is a nominee.

(v) Details (as specified above) of HUF (Hindu undivided family) of which any one or any two or all three of the following are members:

(vi) Details (as specified above) of HUF (Hindu Undivided Family) in the name of my Late Father Late Mr. Deepak Narendra Mishra’s firm in the name and style - “M/s Blue Flame Traders” Hanuman Nagar, Nagpur (vii) Details (as specified above) of any kind of joint accounts in which late Mr. Deepak Narendra Mishra was one of the Account Holders or in which he was a nominee.

(viii) Details (as specified above) of any kind of joint accounts in which Mrs. Kumudini Narendra Mishra is one of the Account Holders or which she is a nominee.

(ix) Details (as specified above) of any kind of joint accounts in which Ms. Ayushi @

Deepshikha Deepak Mishra is one of the Account Holders or which she is a nominee.
