ORDER

1. The Appellant filed an RTI application dated 05.06.2023 seeking information on the following points:

(i) List having Name of Student/s who were/was overage but given the admission in B.Tech (Civil) i.e. who were over age as on 01.07.1995 and 01.07.1996 in the session year 1995-96 and 1996-97 and pass out in the year 2000 (4 years Degree Course) (age limit was not less then 16 years and not more than 23 years in this course).

(ii) List of candidates appeared in Common Entrance Test of B.Tech (Civil) in the year 1995,1996 and 1997.

(iii) List of Candidates/students who were selected for B.Tech (Civil) for the year 1995, 1996 and 1997.

(iv) Copy of Terms and condition to get admission in the year 1995-96 and 1996-97 (pass out in 2000).

(v) In B.Tech (civil) result dated 20.10.2000 student got 64.84% stood Ist Division or IInd division as per your university rules.

2. The CPIO replied vide letter dated 07.07.2023 and the same is reproduced as under :-

(i) No such information is available on record.

(ii) No such information is available on record.

(iii) The information, as desired can not be provided as per clause 8(1)(j) of the RTI Act, 2005.

(iv) The guide to admissions, for the sessions for which information is required are not traceble.

(v) 8.5 > CPI => 6.5 awarded first division whereas CPI < 6.5 awarded second division.

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 21.07.2023 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 09.08.2023, directed the CPIO to provide the information on point no. 5 of the RTI application.

4. Aggrieved with the FAA’s order, the Appellant approached the Commission with the instant Second Appeal dated 13.08.2023.

5. The appellant remained absent during the hearing despite notice and on behalf of the respondent Mr. Qazi Zubair Ahmad, Section Officer, attended the hearing through video conference.

6. The respondent while defending their case inter alia submitted that a point-wise response to the RTI application had been furnished to the appellant vide their letter dated 07.07.2023. He further submitted that the FAA’s order dated 09.08.2023, had been complied with by the CPIO concerned, on 31.08.2023. Hence, no further information remained to be provided to the appellant, he said.

The Commission after adverting to the facts and circumstances of the case, hearing the respondent and perusal of records, observes that the CPIO has provided an appropriate reply to the RTI Application as per the provisions of the RTI Act vide letter dated 07.07.2023 and the FAA’s order has also been complied with on 09.08.2023.

Further, in the absence of the appellant to plead his case or contest the CPIO’s submissions, the Commission finds no scope of intervention in the matter. With this observation, the appeal is dismissed.

Copy of the decision be provided free of cost to the parties.
