SIDDHARTHA MUKHERJEE – Appellant

Hindustan Petroleum Corporation Limited (HPCL) – Respondent


ORDER

1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), O/o Hindustan Petroleum Corporation Limited, Mumbai seeking following information:-

1. “Under which document (Standing Orders or the SHWW-PPR law of 2013), the ICC conducted its inquiry against me.

2. When was the camera recording handed over to the ICC?

3. Complaint of Asha Rani was forwarded to then Head-HR (Marketing).

Did he take the decision to commence inquiry by ICC or the decision was taken by Director-HR.

4. Why was copy of camera recording denied to me before start of ICC inquiry?

Etc.”

2. The CPIO responded on 08-02-2019. The appellant filed the first appeal dated 20-02-2019 which was disposed of by the first appellate authority on 19-03-2019. Thereafter, he filed a second appeal u/Section 19(3) of the RTI Act before the Commission requesting to take appropriate legal action against the CPIO u/Section 20 of the RTI Act, 2005 and also to direct him to provide the sought for information.

Hearing:

3. The appellant, Mr. Siddhartha Mukherjee attended the hearing through audio conferencing. Mr. D Mukharjee, CPIO participated in the hearing
