1. The issues raised in CIC/BKOIN/A/2019/121396 & CIC/BKOIN/A/2019/139842 are similar. Therefore, it is felt desirable that a common order be passed in both the appeals.

1.1. The issues under consideration arising out of the second appeal [CIC/BKOIN/A/2019/121396] dated 03.05.2019 and [CIC/BKOIN/A/2019/139842] dated 13.08.2019 include non-receipt of the following information raised by the appellant through his RTI applications dated 18.10.2018/13.03.2019 and first appeals dated

28.12.2018/01.05.2019:-

CIC/BKOIN/A/2019/121396 (i) “Provide name the authority that instructed/asked the bank to initiate the action of withholding the pension of the appellant. Kindly provide a copy/copies of the relevant order/advice on the basis of which the bank initiated the proceedings of withholding the pension of the appellant.

(ii) The relevant note-sheets, departmental/official orders passed/made by the competent authority regarding the decision to withhold the superannuation pension of the appellant for a period of two years and reducing it to minimum pension per month for the same period w.e.f. 11.06.2018.

(iii) The relevant emails or/and letters written by the Terminal Benefits Department or H R Department, Head Office, Mumbai to Vadodara Zonal Office (Gujarat)

asking it to issue to appellant a letter about the withholding of his pension.”

 CIC/BKOIN/A/2019/109657 i. provide all the information including all the documents relating to the latest IBA guidelines in the light of the latest Bipartite Settlement regarding subsistence allowance and/or minimum pension per mensem or per month in case of the withholding of a retired employee’s/officer’s pension under Regulation 43 of Bank of India (Employees’) Pension Regulations 1995.

ii. provide a copy of each of the IBA guidelines and that of the latest Bipartite Settlement containing this information. Also provide copies of any relevant circular/circulars, notifications, notices, tabulations, classifications and other relevant documents. All other documents related to the calculation of minimum pension under Regulation 43 of Bank of India (Employees’) Pension Regulations

1995.

iii. Please provide the copies of any documents, memoranda, circulars, guidelines, calculation tables issued by the Department of Banking/Financial Services under the Ministry of Finance, Government of India with regard to the calculation of minimum pension per month and/or subsistence allowance effective as on date with regard to Regulation 43 of Bank of India (Employees’) Pension Regulations 1995.

iv. Please provide the copies of all the internal Bank of India Human Resources and Terminal Benefits Department documents, charts, circulars, notifications, departmental memos relating to the minimum pension/subsistence allowance effective as on date with regard to the withholding of pension/superannuation pension of a retired bank employee under Regulation 43 of Bank of India (Employees’) Pension Regulation 1995.

v. provide detailed information including the related documents about the detailed calculation of his (Kanhaiya Lal Sindhi’s) pension for the month of June 2018.

vi. As per the letter (ZOVZ/HRD/KPC/772) dated 21.06.2018 sent to him by Vadodara Zonal Office, which it claims to have been issued at the instance of the Terminal Benefits Department, Head Office, Mumbai, his superannuation pension has been reduced to minimum pension for a period of two years under Regulation 43 of Bank of India (Employees’) Pension Regulations 1995 since 11.06.2018.

vii. provide full information about my proportionate superannuation pension for the first ten days of June 2018 i.e. from June 1 to June 10, 2018, which has not been credited to his pension account ************006, Vidhyadhar Nagar, Jaipur yet.

viii. provide him complete details about the credit of his full monthly pension for the month of July 2018 of Rs. 40,124.97 (forty thousand one hundred and twenty four rupees and ninety seven paise only) into his pension account
