Being dissatisfied, the appellant filed a First Appeal dated 11.09.2023. The FAA vide its order dated 05.10.2023, held as under.

“Appeal Heard. PIOs is directed to provide the desired information to the appellant within 07 days as per rules. Hence, case is disposed off.”

Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.

A written submission dated 06.01.2025 has been filed by the PIO/Enforcement Branch, Transport Department, GNCTD, Delhi is taken on record. Contents of the same are reproduced below:

“…The appellant filed his RTI application dated 25.07.2023 which was responded vide response dated 21.08.2023 enclosing therewith inputs received from Enforcement Branch regarding query (1) of RTI application. Complete list of vehicles lifted by Enforcement Team was provided. However, copies of documents relating to departmental-vehicle DLICAA- 0004 i.e. Pollution Certificate, Insurance-Policy etc were not provided as Insurance for government-vehicles is exempted under section 146(2) of Motor Vehicles Act. Moreover, fuel (Petrol/Diesel) is not available to department's vehicle without production of Pollution Certificate. Query regarding Log Book is vague since period for which copy of Log-Book was sought was not mentioned in RTI application.

Kind reference is drawn to verdict dated 13.11.2019 (Civil Appeal number 2683, 10044 & 10045 of 2010) by Constitution Bench of Supreme Court of India in the matter "Central Public Information Officer, Supreme Court versus Subhash Chandra Agrawal" wherein the Apex Court observed as under.

44. In line with the aforesaid discussion, we need to note that following non- exhaustive considerations needs to be considered while assessing the 'public interest' under Section 8 of the RTI Act.

a. Nature and content of the information b. Consequences of non-disclosure; dangers and benefits to public c. Type of confidential obligation.

d. Beliefs of the confidant; reasonable suspicion e. Party to whom information is disclosed f. Manner in which information acquired g. Public and private interests h. Freedom of expression and proportionality.

In view of above-referred verdict by Hon'ble Supreme Court, it is beyond understanding what purpose would be solved by getting documents relating to a government-vehicle like R.C., Pollution Certificate, Insurance Policy etc.

The appellant filed his undated First Appeal which was disposed of vide an order dated 05.10.2023 directing PIO to provide information as per rules within seven days of appeal-order. Compliance to order was done vide response dated 10.10.2023 by PIO (Scrapping cell) providing available information as per rules and as available on record to rest of the queries i.e. query-numbers (2) to (4). However for further clarification, a copy of RVSF Rules 2021 is being enclosed with these submissions even though the same was not specifically asked for in RTI application.

In view of above, it is requested that the Second Appeal before your honour may kindly be disposed of accordingly.”

The Commission, after adverting facts and circumstances of the case, hearing the respondent and perusal of records observed that replies of the respondent are flawed and queries of the instant RTI application (except point No. 1) in terms of the RTI Act have not been adequately answered. Accordingly, the respondent i.e. PIO, Scrapping Cell, Transport Department, GNCTD, Delhi is directed to revisit the contents of RTI application except point No. 1 and provide a revised updated point-wise information to the appellant as per the provisions of the RTI Act after accessing the same from the concerned department, under Section 5(4) of the RTI Act. Further, the information which is exempted from disclosure be redacted/blackened out.

Important orders/Rules and amendment thereto such as the Order dated 07.01.2025, should be given vide publicity, however, since it was issued just two days before election to the state assembly were announced, it should be done once the present code of conduct period is over.

The above-mentioned directions should be complied by the respondent within 4 weeks of the date of receipt of this order. FAA to ensure compliance of the directions. ADVISORY Further, in the spirit of the RTI Act, advisory under Section 25(5) of the RTI Act is issued to the Respondent Public Authority for (i) amending the concerned Rules to incorporate the provisions for inspection of seized end-of-life vehicles to its owner as allowed in the Order dated 07.01.2025; and (ii) upfront disclosure of information regarding Rules, Bye laws, SoP, Guidelines, Office Orders governing RVSFs (Registered Vehicle Scrapping Facilities) under Section 4 of the RTI Act in public domain, as recently directed by Hon’ble Apex Court in the case titled Kishan Chand Jain v. UOI & Ors. Writ Petition (Civil) No. 990 of 2021 to make it easy for a layperson particularly vehicle owners to get relevant information through website. This will also relieve the Public Authority of the burden of RTI Applications.

The FAA is directed to place a copy of this order before the Competent Authority concerned for compliance with the above advisories.

The appeal is disposed of accordingly.
