MAHESH BHAGERIA – Appellant
Versus
United Commercial Bank (UCO) – Respondent


ORDER

1. The Appellant filed an RTI application dated 12.12.2022 seeking information on the following points:

    (i) Election Commission’s requirement of staff for MCD election.
    (ii) List of staff members supplied to Election Commission for MCD election.

2. The CPIO replied vide letter dated 31.12.2022 and the same is reproduced as under:- “The sought information pertains to third party hence exempted from disclosure u/s 8 (1)(j) & (e) of the RTI Act, 2005.”

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 09.01.2023 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 16.01.2023 upheld the reply of CPIO.

4. Aggrieved with the FAA’s order, the Appellant approached the Commission with the instant Second Appeal dated 27.02.2023. 5. The appellant remained absent and on behalf of the respondent Ms. Neha Gupta, CPIO, attended the hearing in-person.

6. The respondent while defending their case inter alia submitted that the information i.e. personal details of staff members delegated with election duties (for MCD elections) was exempted under the provisions of Section 8 (1) (e) & (j) of the RTI Act.
