Complainant: Shri R. Baskar participated in the hearing through video conferencing from NIC Chennai.
Respondent: Shri A, Jayasimha, CPIO and Chief Mechanical Engineer, Chennai Port Trust participated in the hearing through video conferencing from NIC Chennai.
ORDER
Information sought:
The Complainant filed an online RTI Application dated 16.08.2018 seeking information on the following eleven points:
1) “Details to be furnished in respect of the following hiring cars by Chennai Port Trust for its officials Copies of Trip sheet/log book to be furnished for the period from 01.01.2018 to till date to the following vehicles.
a) TN 01 AW 4968 Ford Fiesta A/c
b) TN09 CA 3308 TATA. SAFARI STROME
c) TN 09 CF 0857 MARUTHI SUZUKI SWIFT DZIRE
d) TN 09 CF 0914 MARUTHI SUZUKI SWIFT DZIRE
e) TN09 CF 0094 MARUTHI SUZUKI SWIFT DZIRE
f) TN09 CF 0948 MARUTHI SUZUKI SWIFT DZIRE
2) Whether any of the officer has been provided two car simultaneously, if yes name of the officer and registration number of vehicle shall be provided.
3) Fuel filling details to be furnished for above said vehicles for the above period.
4) Snap shot of current odo meter or any other material evidence to show that current reading to be furnished for the above vehicles.
5) Can any vehicle without yellow number plate are utilized for ferrying of officers of the Trust. if so, furnish the details along with registration number, and name of the officer.
6) The following cars are registered under tourist cab license for operating tourist or public service, now the said cars has changed the number plates in white colour for signing own board cars whether any approval obtained from competent transport authority to shift over yellow board to white board, if yes furnish the relevant copies.

7) To change yellow board to white board for the cars hired by the Port whether the tourist operators got any competent sanction from the respective authority and submitted to Chennai Port Trust to qualify to operate public services, if so, furnish the details.
8) As per the Tamil Nadu Motor Vehicle Act- 1989 no cars shall be allowed to carry passengers for public service with white board. The signified White board vehicles is permitted only as own purpose vehicles., Under which circumstances the said cars rendering public service, have changed the number plate to white board. Any specific approval got from the competent authority for operating own (white) board cars for public service.
9) The life tax difference paid to RTO for changing from yellow board tourist cab to white board shall be furnished.
10) At the time of switching over from yellow board to white board i.e. passenger vehicle to own purpose vehicle the quantum of life tax difference amount paid to concerned RTO shall be furnished by each of such cars hired by the Port.
11) Can the Chennai Port Trust which has awarded contract for hiring of cars based on tender shall utilize the white board cars for transportation of Chennai Port Trust officials, if so furnish the rule provision.”
The CPIO vide letter dated 15.09.2018 provided point-wise information to the Complainant. Being dissatisfied, the Complainant approached the Commission in the instant Complaint.
Grounds for Complaint:
The Complainant filed a Complaint u/s 18 of the Act on the ground of incomplete and misleading information provided by the Respondent. He requested the Commission to direct the CPIO to provide complete information sought for and take appropriate legal
