O R D E R
1. The Appellant filed an RTI application dated 05.11.2022 seeking information on the following points:
(i) Complaint about atm/online fraud complaint number is 101325216, 101325853, 101331405, 101331147, 101335503, 101330798, 101323616, 10, 1323916….etc.
2. The CPIO replied vide letter dated 03.12.2022 and the same is reproduced as under :-
“It is advised that information in this regard has been sought from concerned department which is expected to materialize by 20.12.2022, on receipt of relevant information the same will be shared with you.”
3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 22.12.2022 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 07.01.2023 observed as under:
“The appellant has sought detailed information regarding ATM fraud in his account on 28.05.2022. The CPIO has provided interim reply to the appellant on 03.12.2022 stating that information is expected by 20.12.2022. However, appellant has expressed his dissatisfaction over the reply of the CPIO and preferred this appeal by stating that no information has been received even after more than 45 days have passed. Therefore, CPIO is directed to re-look into this aspect and give appropriate reply to the appellant as per the provisions of RTI Act within 15 days of receipt of this order.”
4. Aggrieved with the FAA’s order, the Appellant approached the Commission with the instant Second Appeal dated 19.05.2023.
5. The appellant remained present through video conference and on behalf of the respondent Mr. Vipin Kaushal, CPIO attended the hearing through video conference.
6. The appellant inter alia submitted that he has sought information regarding ATM fraud in his account. Despite the order of FAA, the Respondent has failed to provide any information.
7. The respondent while defending their case inter alia submitted that compliance of the First Appellate Authority’s order has been done dated 22.02.2023.
8. The Commission after adverting to the facts and circumstances of the case, hearing both parties and perusal of records, observes that as per the records of the Commission the CPIO has provided interim reply to the Appellant on 03.12.2022. Therefore, the Commission directs the Respondent to furnish a suitable final reply to the Appellant, as per the provisions of the RTI Act, under intimation to the Commission, within 15 days of the receipt of the order. Accordingly, the appeal is disposed of.
Copy of the decision be provided free of cost to the parties.
