(19.04.2023) 1. The issue under consideration arising out of the second appeal dated 10.06.2021 include non-receipt of the following information sought by the appellant through the RTI application dated 16.09.2020 and first appeal dated 15.03.2021:-
Information based on investigation report of Mr. V M Kumar vide reference No. VIGS:INV:VMK:09 dated 04.07.2014.
(i) Provide certified copy of the investigation report No. VIGS:INV:VMK:09 dated 04.07.2014.
(ii) Provide certified copy of two emails dated 21 st August 2014 @ 1.53 p.m. from IRD Visakhapatnam addressed to the petitioner which reads as quote: We are in the process of obtaining complete sock register from the police department.
In the meantime, we advise you to compare the available pages of the stock register filed by the police department in the court with the stock register submitted by you to the Zonal Manager, Visakhapatnam Zone, to reply for the supplementary memorandum calling for explanation issued to you.
(iii) Provide the correspondence exchanged between the police and Vijayawada Zonal Office while conducting investigation based on the complaint lodged with Lokayukta.
(iv) Provide copy of the documents based on which Mr. V M Kumar had concluded that quote: Investigation has now revealed that, the copies of the stock register which Mr. Rao had submitted to the Zonal Manager are concocted ones.
(v) Provide certified copy of the actual stock register submitted by police to Bank of India. QUOTE: The police have recently handed over the photo copies of the actual stock register seized by them from the cold storage. UNQUOTE. Refer para No ( iv ) under sub head ( C) Allegations against Shri V V Subba Rao, Former BDM Guntur in page No 5 of the investigation report dated 04-07- 2014.
(vi) Provide the copies of the actual stock register submitted by police, which contains the entries of the names of the Bogus borrowers. QUOTE. However, the copy of the register seized by the police also have the entries of the names “of Bogus”
borrowers, who had actually put no stock, obviously because such entries were required as loans were availed in their names form the Branch UNQUOTE. Para (iv) under the sub head (C) allegations against Shri V V Subba Rao, Former BDM Guntur as per page No 6 of the investigation report dated 04-07-2014.
(vii) Provide the documentary evidence to arrive at the conclusions as reported in the investigation report page No 6 para II.7 of investigation report vide reference No VIGS:INV:VMK:09 dated 04-07-2014 which reads as QUOTE: It is obvious that he wanted to shield the Branch Officials/ the cold storage owner from the allegation of bogus financing against fake cold storage Receipts, without keeping any stock in the cold storage UNQUOTE (viii) Provide the covering letter of Amaravahti police who have sent a copy of the case dairy Crime No 40/2014 Pedakurapadu PS as reported in para G sub Para II.11 of investigation report page No 8.
(ix) Provide certified copy of the statement of Mrs. Nakkala Leela Kumari dated 27-
04-2014 given before witness and mentioned in para 2 of page No 10 of the investigation report dated 04-07-2014 and submitted to Zonal Office by police.
(x) Provide certified copies of the three or four post stock inspection reports mentioned in his written statement to police QUOTE: Bank officers have come to the cold storage nearly 3-4 times for inspection, but never entered inside the cold storage. UNQUOTE as reported in para 4 under the head statement of Shri Battula Ravichand in page no 11 and 12 of the investigation report dated 04-07-
2014 (xi) Provide the written statement of Mr. Pilli Venkateswarlu, Sr Branch Manager Chenchupeta Branch, dated 26-03-2014 as mentioned in page No 14 under sub para 16 of investigation report which had stated that QUOTE: He had stated inter alia, that the farmers had felt it difficult to come all th
