ORDER

1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Life Insurance Corporation of India, Tirunelveli seeking following information:-

1. “Two Policies are there, one has been closed and other one is in progress. I reached the office to get the closing information about the closing policy. But the officer asked me to submit all the original (already submitted) for verification of Account Book & Agents Attestation believing that all of these are unnecessary things while all of them are in the current policy. So I want to avoid the negligence of LIC. I like to get the Rules and Regulations copies of Government, IRDA, Central Office of LIC.

2. Submit the details of Rules and Record copies of Agents Regulation Act 1972, IRDA Act about Agents commission.

3. I had applied a complaint petition to the Divisional Manager. But the Branch Manager has replied for it what is the reason. I want to know the processing of dispatching of the letter through one by one. Give me the comments and officers file details, information, record copies.

4. In the replies letter the Branch Manager has not given the Initial he signs in full name in the payment Ledger, is this applicable in the Government, IRDA, Central LIC Rules and Regulations details of record copies.

5. Give the record copies of the Branch Manager and the officer in- charge Mr. Anbu where both of them have been appointed on which post and when and have been transfer from where to where to where.

6. Give the details and record copies of higher authority and office details of failure service LIC and agents and default of the policy holder.

7. Give me the full records of balance sheet of Policy No: 320070244 with the corresponding the letter copies from beginning to end with the payment amount and date details.

8. Give me the permission to identify the Policy holder protection to Rules and Regulation Act, IRDA Act, and default of LIC Officers and agents (Book, Government orders)

9. Give the list of officers in your office workers and Job details of progressing.

10. Give me the details of the Record Copies of the commission taken by the Agent, LIC Officers from low to high.”

2. The CPIO responded on 27-08-2018. The appellant filed the first appeal dated 26-09-2018 which was disposed of by the first appellate authority on 23- 10-2018. Thereafter, he filed a second appeal u/Section 19(3) of the RTI Act before the Commission requesting to take appropriate legal action against the CPIO u/Section 20 of the RTI Act, 2005 and also to direct him to provide the sought for information.

Hearing:

3. The appellant, Mr. Raja D. Sundar Singh attended the hearing through video conferencing. Smt. P.I. Vajreswari, Manager (CRM)/CPIO participated in the hearing representing the respondent through audio conferencing. The written submissions are taken on record.

4. The appellant limited his submissions on supplying the specific web- address of the IRDAI rules and regulations along with list of officers working in Life Insurance Corporation of India, Tirunvelveli.

5. The respondent contended that the query raised by the appellant on point no. 1 is clarificatory in nature which is not covered u/Section 8(1)(d) of the RTI Act, 2005. She informed the Commission that the rules and regulations of IRDAI are available on the website of IRDAI. She expressed no objection in sharing the name and designation of the officers working in Life Insurance Corporation of India, Tirunvelveli.

Decision:

6. This Commission observes that the query raised on point no. 1 is non- specific which requires analyses and interpretation of various IRDAI rules/documents. Therefore, this sort of queries seeking clarification from the CPIO are not covered within the definition of ‘information’ u/Section 2(f) of the RTI Act, 2005. In this regard, the Commission refers to the definition of ‘information’ u/s Section 2(f) of the RTI Act, 2005 which is reproduced below:-
