Shashi Bhushan Shrivastava – Appellant

The Appellant filed an RTI application dated 24.09.2021 seeking information on the

following points:

(i)

“The authority by which Mr. Rajat Mishra, CM-HRD has changed the decision

of disciplinary authority and inflicted upon me from retirement date

(retrospective date).

(ii)

Copy of Central Bank Law & Regulation in connection with that also be given

to me.”

The CPIO replied vide letter dated 11.10.2021 and the same is reproduced as under:-

i.

“Since you had been retired from Bank's services of on 30.06.2017 and the

penalty of "Dismissal" cannot be effected after date of retirement and also in

view of invocation of Regulation 20.3(iii) of OSR, it is implied that the imposed

penalty vide final Order should be inflicted from the last working day of your

Bank's service i.e. your date of retirement. Hence, there is no change in the

decision of penalty awarded by DA i.e. "Dismissal".

ii.

The required information/document is not specified by you, as there is no such

law in the name and title of "CBI Law & Regulation" is there.”

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First

Appeal dated 12.11.2021. The FAA vide order dated 06
