1. The issues under consideration i.e. the reliefs sought by the complainant in the complaint dated 18.07.2019 due to alleged non-supply of information vide RTI application dated 26.03.2019 are as under:-

 “Take necessary action as per the provisions of the RTI Act.”

2. Succinctly facts of the case are that the complainant filed an application dated 26.03.2019 under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Vijaya Bank, Bangalore, seeking following information:

“Certified copies of following documents pertaining to our loan account no. ***********0067

(i) Copy of the loan sanction letter along with terms & conditions and acknowledgement of receipt of the same.

(ii) Copy of the statement of account from the date of sanction till date.

(iii) Copy of the Memorandum of Interest Account for the said account from the date of NPA till date.

(iv) Copy of the details of rate of interest charged for the said account for the period 31.03.2008 till date.

(v) Copy of the audited balance sheet for the period 2008 to 2011 stating our account as NPA.

(vi) Copies of all the entries made & reasons mentioned in the concerned registers under which category the account is classified as NPA.

(vii) Copy of the list of approved panel advocates/auditors/valuators of your bank for Bangalore & Chennai circle of the period 31.03.2008 till date.

(viii) Copy of the list of approved penal recovery/security/agencies of your bank for the period 31.03.2009 to 31.03.2013.

(ix) Copy of the loan recall notices issued if any, against our said account along with copies of all entries made in the concerned registers & dispatch register regarding issuance of the same along with acknowledgment of receipt of the same.

(x) Name & designation of the officer who has issued this demand notice alongwith copies of all the entries made in the concerned dispatch register regarding issuance of demand notice u/s 13(2) of the SARFAESI Act dated 01.08.2008 to the borrower & guarantors along with acknowledgement of receipt of the same.

(xi) Name & designation of the Officer who has issued this possession notice along with copies of all the entries made in the concerned dispatch register regarding issuance of possession notice u/s 13(4) of the SARFAESI Act dated 25.10.2008 along with acknowledgment of receipt of the same.

(xii) Copies of publications of possession notice in newspaper dated 26.10.2008.

(xiii) Copies of all the entries made in the concerned register regarding making payments towards publication of possession notice u/s 13(4) of the SARFAESI Act along with copies of bills & acknowledgment of receipt of the same.

(xiv) Name & designation of the Authorized Officer who has issued the possession notice along with copy of the photographs taken if any regarding affixing possession notice u/s 13(4) of the SARFAESI Act.

(xv) Copies of all the correspondences between the branch, bank & Authorized Officer & valuator regarding seeking valuation of the property from Mr. S. R. Nandakumar along with acknowledgment of receipt of the same.

(xvi) Copies of all the payment entries made in the concerned register towards availing the valuation report for the said property & accounts along with acknowledgment of receipt of the same.

(xvii) Copies of all the entries made in the concerned dispatch register against the recommendations done by the Authorized Officer to the Circle Officer regarding fixing auction sale & reserve price.

(xviii) Copies of all the SARFAESI Enforcement Committee (SEC) Meetings held regarding fixing the reserve price as Rs. 23,00,000/- & auction sale dated 11.06.2010 against the said property & said accounts.

(xix) Copies of all the correspondences between the Branch & the Circle Office regarding the cancellation of the auction sale dated 20.04.2009, 09.09.2009 & the reasons made in the concerned register regarding the same.
