Information sought:

The Complainant filed an RTI application dated 31.08.2023 (offline) seeking the following information:

The PIO furnished a reply to the complainant on 04.10.2023 stating as under:

“Ans 1.2 & 3 The RTI application cannot be processed as no specific information is seek by applicant under RTI Act, 2005.”

Being dissatisfied, the complainant filed a First Appeal dated NIL. The FAA vide its order dated 25.10.2023, held as under:

“The appeal was conducted on 25.10.2023, ACDMO(ND), APIO(RTI) DGHS and appellant were present in the appeal. CDMO (ND) is directed to provide the modified reply within 5 days to the appellant.

Order passed and appeal disposed of accordingly.”

In compliance of FAA’s order, the PIO furnished a revised point-wise reply to the appellant on 31.10.2023 and denied the information under Section 8(1)(j) of the RTI Act read with section 2.2 chapter 2 of CODE OF MEDICAL ETHICS REGULATIONS, 2002.

Feeling aggrieved and dissatisfied, complainant approached the Commission with the instant Complaint.
