ORDER

1. The Appellant filed an RTI application dated 03.12.2021 seeking information on the following points:

• Kindly provide the following information related to your branch for the Home loan A/c No. xxxxxxxxxxx1011.

(i) (a) When was the home loan sanctioned?

(b) Who was the competent authority to sanction the loan…etc.

(ii) (a) When was the loan disbursed?

(b) To whom the loan was disbursed…etc (iii) (a) Kindly provide the certificate copy of the property, against which the loan was sanctioned and disbursed?

(b) What is the current status of the property against which the loan had sanctioned… etc?

(iv) (a) Had all the documentation completed before sanction and disbursement of the loan? Kindly provide the list of documentation.

(b) Had any negligence found in the sanction of loan and its disbursement?

If yes, please elaborate … etc.

(v) (a) What is the guidelines of RBI in the sanction and disbursement of home loan? Kindly provide a certificate copy of it.

(b) Had all the guidelines of RBI fulfilled in this case? If not, then provide the reason….etc.

2. The CPIO replied vide letter dated 14.03.2022 and the same is reproduced as under :-

(i) (a) The home loan was sanctioned on 25.08.2017.

(b) The competent authority to sanction the loan was Chief Manager…etc.

(ii) (a) The home loan was disbursed on 08.09.2017.

(iii) (b)The home loan was disbursed to M/S Manju J Homes India Ltd (Builder)…etc (iv) (a) The loan was sanctioned under TPA with builder (Allotment Letter/Flat buyer Agreement is enclosed).

(b) The property is under construction (v) (a) List of documents is as under:-

Sanction letter, Agreement of Guarantee etc..

(b) No negligence found in the sanction of loan and its disbursement… etc.

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 24.01.2022 alleging that the information provided was incomplete, false and misleading.

4. Due to non-receipt of any order from the First Appellate Authority, the Appellant approached the Commission with the instant Second Appeal dated 11.05.2022.

5. The appellant and on behalf of the respondent Mr. Vishal Agarwal, AGM and Mr. Lakshit Nautiyal, Manager Law, attended the hearing in person.

6. The appellant inter alia submitted that false and incomplete information was furnished by the respondent on point no. 4 (b) and 6 (b) of the RTI application. He further submitted that the then CPIO demanded fees of Rs 90 for pages/documents sought under the RTI application. However, the information sought should have been furnished free of cost as per section 7 (6) of the RTI Act, 2005, as there was an undue delay in furnishing a proper reply to his RTI application. He requested the Commission to direct the respondent to furnish the information on point no. 6 (b) of the RTI application, free of cost and the Rs 90/- charged by the respondent should also be returned as there was an undue delay in furnishing a reply from the respondent.

The respondent while defending their case inter alia submitted that a point-wise response to the RTI application in accordance with the provisions of the RTI Act, 2005, had already been furnished to the appellant vide their letter dated 14.03.2022. Hence, no further information remained to be provided to the appellant, he said. 8. The Commission after adverting to the facts and circumstances of the case, hearing both parties and perusal of records, observes that a point-wise response to the RTI application has been furnished to the appellant vide their letter dated 14.03.2022.
