An appeal under the RTI Act cannot be filed for multiple RTI applications, and procedural defects render the appeal not maintainable.

O R D E R

1. The Appellant filed an RTI application dated 07.01.2023 seeking information on the following points:

(i) “िब(cid:4)दु सं० 1- उपरो(cid:14) के स(cid:17)(cid:18) म(cid:20) (cid:21)ाथ(cid:24) ने िदनांक 18.08.2022 को च(cid:27)ावती ितवारी लॉ

कॉलेज, कोट#ार (स(cid:17)$ - हे०न०ब०ग०िव०िव०, ’ीनगर (गढ़वाल)) से एल.एल.बी. कोस* के छठे सेमे-र के 'प./क इंटरनेशनल लॉ िवषय की परी4ा दी थी। िजसका अनु7मांक- 19122108038 व नामांकन सं०- G921460 है। अतः कृपया करके मुझे उ(cid:14) िल.खत िवषय की बा= परी4ा की उ>र पु.?का की स@ािपत (cid:21)ितिलिप उपलA कराने का कB कर(cid:20)। L (ii) िब(cid:4)दु सं० 2- उपरो(cid:14) िवषय के स(cid:17)ंध म(cid:20) यह बताने का कB कर(cid:20) की (cid:21)@ेक िवषय म(cid:20) बा=

परी4ा व आंतEरक परी4ा म(cid:20) उ>ीण* होने हेतु Gूनतम िकतने अंकों की आवIकता होती है।

(iii) िब(cid:4)दु सं० ३- यह िक उ>र परी4ा की पुनः जांच कराने की (cid:21)ि7या की पूण* जानकारी

उपलA कराने का कB व उ(cid:14) (cid:21)ि7या से स(cid:17).(cid:18)त आदेश/शासनादेश की स@ािपत (cid:21)ितिलिप उपलA कराने का कB कर(cid:20)।

(iv) िब(cid:4)दु सं० 4- यह िक आंतEरक परी4ा के अंकों को िवKिवLालय की साइट पर अपलोड करने के पNात उसम(cid:20) संशोधन करने के िनयमों की सOूण* जानकारी उपलA कराने का कB कर(cid:20) व उ(cid:14) (cid:21)ि7या से स(cid:17).(cid:18)त आदेश/शासनादेश की स@ािपत (cid:21)ितिलिप उपलA कराने का कB कर(cid:20)।“

2. The CPIO replied vide letter dated 31.01.2023 and the same is reproduced as under:-

i. “िविध षBम् सेमे-र, अनु7मांक‐19122108038, (cid:21)\‐प] ‐ Public International Law की उ>रपु.?का की छाया(cid:21)ित (cid:21)ाl करने हेतु कॉलेज आई०डी०/आधार काड*/फोटो पहचान प] आिद की p(cid:21)मािणत छाया(cid:21)ित इस काया*लय को (cid:21)ेिषत कर(cid:20)गे। पEरचय प] की छाया(cid:21)ित (cid:21)ाl होने के पNात् ही उ>रपु.?का की छाया(cid:21)ित दी जानी सqव होगी।

ii. सी०बी०सी०एस० (cid:21)णाली म(cid:20) आrEरक एवं बा= परी4ा म(cid:20) (30+70=100) Gूनतम 35/100 अंक (cid:21)ाl करने अिनवाय* हy।

iii. िवKिवLालय म(cid:20) पुनः जांच करने का कोई िनयम नही ंहै।

iv. आrEरक परी4ा के अंक स(cid:17).(cid:18)त कॉलेज के (cid:21)ा{ापक #ारा अपनी आई०डी० के

मा{म से िवKिवLालय की वेबसाइट पर अपलोड िकये जाते हy, त|Nात् आई०डी० लॉक हो जाने के बाद पुनः संशोिधत िकया जाना सqव नही ंहै।“

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 20.03.2023. The FAA vide order dated 10.04.2023 stated that:

लॉ कॉलेज, िश(cid:128)ूनगर, कोट#ार को इस आशय से (cid:21)ेिषत िक संल(cid:129) अनुरोध प] म(cid:20) मांगी गयी िब(cid:4)दु सं}ा-5 की सूचना त(cid:130)ाल अनुरोधकता* को (cid:21)ेिषत करने का कB कर(cid:20) तथा इसकी एक (cid:21)ित इस काया*लय को भी (cid:21)ेिषत की जाय। िनण*य (Decision):

अतः लोक सूचना अिधकारी / परी4ा िनयं]क मु} परी4ा एवं (cid:21)ाचाय* / िनदेशक च(cid:27)ावती ितवारी लॉ कॉलेज, िश(cid:128)ूनगर, कोट#ार को िनद(cid:132)िशत िकया जाता है अनुरोधकता* को अनुरोध प] के सापे4 वांिछत सूचनाय(cid:20) अपीलीय आदेश (cid:21)ा.l के एक सlाह के अrग*त िनशु(cid:133) (cid:21)ेिषत की जाय” 4. Aggrieved with the FAA’s order, the Appellant approached the Commission with the instant Second Appeal dated 24.07.2023.

5. The Appellant was present during the hearing and on behalf of the Respondent, Vijay Pal Singh Bhandari, CPIO attended the hearing through video conference.

Both the parties were heard at length, during the course of which, it transpired that the Appellant was agitating on not having received the certified copy of his answer script sought for at point no.1 of the RTI Application and that the copy of the answer script was received much later, by which time, he could not apply for rechecking as he found out that he lost out on the exam due to incorrect marking/totaling. Soon after, the Appellant started to argue regarding a subsequent RTI Application filed by him on 09.02.2023 asking for the same copy of answer script among other queries and now through this appeal, he wanted relief on both these RTI Application(s).
