1. The Appellant filed an RTI application dated 12.10.2023 seeking information on the following points:

 With reference to your Advertisement for Non-teaching positions against Advt. ID:

IIMR/Rect./Non-Teaching/2023/02 Dated 9th August 2023 In this connection, I want the following information under the RTI Act 2005.

(i) Please provide the mark details of all the Eighteen (18) candidates (All UR, OBC, ST, EWS Candidates) with name & registration no wise, who will appear in the Written Test held on 09.10.2023 (Monday) for the post of Administrative Assistant (on contract), Level-4, Entry Pay Rs.25,500, including my name Rishabh Srivastava Kindly send the details to my email address:

(ii) What are the criteria for the marks/cut-off evaluation.

(iii) Please provide the waiting list of final results for the post of Administrative Assistant (on contract), Level-4, Entry Pay Rs.25,500., Kindly send the details to my email address: risha****70@gmail.com.

(iv) Please provide the marks of all the Six (6) Selected candidates (UR, OBC, ST, Candidates) as well as the marks of the waitlisted candidates to be appeared in the Written Test held on 09.10.2023 (Monday) for the post of Administrative Assistant (on contract), Level-4, Entry Pay Rs.25,500., Kindly send the details to my email address: risha****70@gmail.com.

(v) Please provide the cut of score all the Six (6) selected candidates (UR, OBC, ST, Candidates) as well as the cut of score of the waitlisted candidates to be appeared in the Written Test held on 09.10.2023 (Monday) for the post of Administrative Assistant (on contract), Level-4, Entry Pay Rs.25,500., kindly send the details to my email address: risha****70@gmail.com …, etc./ other related information

2. The CPIO replied vide letter dated 27.10.2023 and the same is reproduced as under :-

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 01.11.2023 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 05.12.2023 upheld the reply given by the CPIO and provided additional information as follows:

“i. iv. v. & x. As mentioned in the Table ii. the Committee fixed the following criteria for various categories:

UR-50%

EWS-50% OBC-45%

ST-40%

iii. As mentioned in the Table (enclosed)

vii. The requisite information is exempted under Section 8 (1) (e) and (j) of the RTI Act.

viii. ix. You are hereby granted permission to come to the Institute and review your answer key in presence of the in-charge establishment department. You will visit the Institute in December 2023.

Your access will be limited to viewing your answer key and no copying of the Materials will be allowed.”

4. Aggrieved with the FAA’s order, the Appellant approached the Commission with the instant Second Appeal dated 28.12.2023.

5. The appellant and on behalf of the respondent Shri Chandrakant Swain, CPIO, attended the hearing through video conference.

6. The appellant inter alia submitted that he had not received a copy of the model paper and the scores obtained by selected candidates for the examination conducted in pursuance to the Advertisement for Non-teaching positions against Advt. ID:
