2nd Appeal/Complaint dated : NIL Information sought:

1. The Appellant filed an RTI application dated 04.09.2023 (offline) seeking the following information:

“1 Copy of the Note sheet pertaining to MACP proposal to Library Assistant of MTPG&RIHS including views / opinion of the Health Secretariat and DP&AR of Puducherry Administration, Puducherry.

2. Copy of the minutes and agenda of all governing body meetings along with approval of the Competent Authority held during 2023-24.

3. Note sheet and memorandum along with the approval of the Competent Authority for the Promotion proposal done in the department of Physiotherapy, Nursing and Pharmacy from the year 2020 to till date.

4. Copy of the Note sheet and Memorandum for absorption and appointment of Peon, Sanitary Assistant, MTS (Housekeeping).

MTS(General) from 2012 to till date.

5. Note sheet, Order and extension order for appointing Contract based Assistant, Superintendent, Assistant Registrar and Consultant along with the pay given to them from their appointment.

6. Expenditure and salary spent for the post of Contract Assistant, Contract Superintendent, Contract Assistant Registrar and Consultant from 2017 to till date.

7 Copy of the case pending in this institute from 2008 to till date.”

2. The CPIO furnished a point-wise reply to the Appellant on 29.09.2023 stating as under:

“1. In terms of Clauses (f). (h) & (i) of Section 2 of the RTI Act, 2005, the information requested therein is not available within the custody of the Public Information Officer at present.

2. The information sought for is not clear and specific. Doing research on the information sought for, making analysis of data, deriving certain inferences or conclusions based upon the data so collected and furnishing information after an enquiry cannot be construed as information as defined under Section 2(f) of the RTI Act, 2005. Hence, it cannot be furnished

3. The information sought for by the applicant involves compilation of information over a period of 4 years since 2020 and it amounts to subjecting the undersigned to information gathering and dispensing it at the cost of discharging normal function and it has the potential of disproportionate diversions of Public resources and impede the normal and regular works of this public institute Under the RTI Act, the undersigned has no obligation to cull out and supply the information to him so as to suit the need of the applicant.

4. The information sought for is not clear and specific. Doing research on the information sought for, making analysis of data, deriving certain inferences or conclusions based upon the data so collected and furnishing information after an enquiry cannot be construed as information as defined under Section 2(f) of the RTI Act, 2005.

Moreover, The disclosure of information of this amplitude will amount to disproportionate diversions of Public resources and impede the normal and regular works of this public institute. Hence, it cannot be furnished.

5. The information sought for herein involves service matters, personal details and information of the retired officials which are closely connected to third parties and attract fiduciary relationship. Hence, the disclosure of third-party information suo-motto will cause unwarranted invasion of their privacy, and it will be converted into
