O R D E R

1. The Appellant filed an RTI application dated 15.09.2022 seeking information on the following points:

(i) “Whether the Courses mentioned in Column A in the table below from the institutions mentioned in Column B are accredited under the All India Council for Technical Education (AICTE)?

If Yes, then the period of validation of the accreditation of the institutions mentioned in Column “B”.

2. Aggrieved with the non-receipt of any reply from the CPIO, the Appellant filed a First Appeal on 10.11.2022. FAA’s order, if any, is not available on record.

3. Due to non-receipt of any order from the First Appellate Authority, the Appellant approached the Commission with the instant Second Appeal dated 24.01.2023.

4. The Appellant remained absent during the hearing and on behalf of the Respondent, Dr. M S Ghuge, Asstt. Director & CPIO along with Nishant, YP attended the hearing in person.

5. The Respondent submitted that the reply to the RTI Application was provided to the Appellant on 18.10.2022 stating that the accreditation to the averred courses do not fall under the ambit of AICTE and the First Appeal was also decided on 28.12.2022. It was further submitted that that ‘AICTE is giving approval for conducting Diploma program of 3 years duration and not awarding accreditation to short term programs less than 3 years while none of the program listed in the table is of 3 years duration’.

The Commission after adverting to the facts and circumstances of the case, and perusal of records, observes that the CPIO has provided an appropriate reply to the RTI Application as per the provisions of the RTI Act. However, in the absence of the Appellant to confirm the receipt of the averred reply and considering the fact that the instant appeal was filed on the grounds of non-receipt of CPIO’s reply, the Commission directs the CPIO to resend a copy of the same to the Appellant via email and speed/registered post within 7 days of the receipt of this order.

7. The Appeal is disposed of accordingly.
