1. The Appellant filed an (offline) RTI application dated 22.12.2023 seeking the following information:

3:- 01 अ(cid:12)ैल 2022 से लेकर 31 जनवरH 2023 तक कायाBलय हैड आ(cid:10)फस मैन (cid:12)वेश !वार ((cid:22)सDयो?रटH गेट) रिज7टर म6 (cid:28)ीम(cid:1)त (cid:22)श4पी ने कायाBलय कE पा(cid:10)कOग म6 अपने प(cid:1)त कE गाडी कहकर खडी करवायी थी। उस गाडी का न*बर उस प(cid:1)त का नाम व (cid:28)ीम(cid:1)त (cid:22)श4पी के नाम से (cid:10)कतनी बार कार खडी कE गयी

थी। उस रिज7टर कE (cid:12)Kयेक सKया#पत कापी उपलLध करायी जाये”

2. The CPIO furnished a reply to the Appellant on 03.01.2024 stating as under:

“Qबदं ुसंRया 1 एवं 2:-मांगी गई जानकारH SयिDतगत (cid:12)कृ(cid:1)त कE है।

Qबदं ुसंRया 3 :-मांगी गई जानकारH #व(cid:22)शTट नहHं है।”

3. Being dissatisfied, the appellant filed a First Appeal dated 12.01.2024.

The FAA order is not on record.

4. Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.

5. The following were present:-

Appellant: Absent.

Respondent: Ms. Jasmine Dhar Singh, GM (HR)-cum-CPIO present in person.

6. Written submission filed by the Respondent is taken on record. Contents of the same are reproduced below for ready reference:

1. “It is humbly submitted that the RTI application dated 22.12.2023 of the applicant had been promptly replied vide letter dated 3.1.2024 by the undersigned.

2. The AA-I vide Order dated 16.2.2024 had stated that application dated

22.12.2023 of the applicant has been replied vide letter dated 3.1.2024 by CPIO and no infirmity has been found in the decision of CPIO. Hence, AA-I had upheld it, and appeal was disposed of accordingly by AA-I.

3. It is submitted that the applicant has sought record of attendance register and biometric attendance of an employee working on contract basis. The attendance record is part of a service record and is an arrangement between an employer and an employee. It is also submitted that the disclosure of the information sought regarding attendance could endanger life or physical safety of the concerned employee and may hence be exempted under Sec 8(1)(g) of RTI Act. No public interest has been disclosed and disclosure of this information may be exempted as the same may also cause unwarranted invasion of the privacy of the individual under section 8(1)(j) of the RTI Act.

4. The applicant has also sought certified copy of monthly salary slip of the aforesaid contractual employee. It is submitted that no public
