1. The Appellant filed an RTI application dated 18.12.2023 (online) seeking the following information:

“RELATED TO DUAL FAMILY PENSION CASE This RTI is related to your office. Therefore, please do not send this RTI to any other office/department. Please get the attachments and proceed further only with the information sought in this RTI application. Please provide only handwritten letter point wise information along with all relevant documents and formats immediately. Kindly send the response of this RTI application via Speed Post only.

This very very most serious and urgent matter so please accord Top Priority to this grievance.”

2. The CPIO furnished a reply to the Appellant on 17.01.2024 stating as under:

“Request disposed of vide this office letter No.AN/RTI/5187/MKY/2023, dated 09-01-2024”

3. The CPIO furnished a reply to the Appellant on 09.01.2024 stating as under:

“With reference to above it is intimated that you have not sought for any specific information as defined in section 2(f) of the RTI Act-2005, rather raised query regarding dual family pension. In this regard, it is stated that this office deals with pension of defence personnel and defence civilions. Hence, you may liaise with Record Office/ HQ and Pension Sanctioning Authority to settle your query regarding dual family pension.”

4. Being dissatisfied, the appellant filed a First Appeal dated 20.01.2024.

The FAA vide its order dated 07.02.2024, held as under:

“Appeal disposed vide this office letter No. AN/RTI/5826/MKY/2023 Dt

31/01/2024.”

5. The CPIO furnished a reply to the Appellant on 31.01.2024 stating as under:

6. Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.

7. A written submission dated 30.07.2025 filed by the Respondent is taken on record. Contents of the same are reproduced below:

1 That, the appellant through his RTI application dt. 18-12-2023 had made query about dual family pension for disabled son.

2. That, his application was responded to by the then CPIO vide letter bearing No. AN/RTI/5187/MKV/2023 dt. 09-01-2024 advising him to liaise with Record Office/H.O.0. to settle his query regarding dual family pension.

3. That , the appellant had filed First Appeal dt. 20/01/2024 expressing dissatisfaction with the reply.

4. That, his Appeal was responded vide letter no. AN/RTI/5826/MKV/2023 dated 31/01/2024 advising again to liaise with Record Office/HQ to settle his query regarding dual fam
