CIC/UIICL/A/2024/609249

Advocates:

Disclosure of financial information necessary for legal proceedings outweighs personal privacy concerns under the RTI Act.

Headnote:(A) Right to Information Act, 2005 - Section 8(1)(j) - The appellant sought personal information regarding the financial status of her estranged husband for maintenance proceedings. The CPIO denied the information citing personal privacy exemptions. The Commission held that government employees' pay scales and designations should be publicly disclosed for transparency. The denial was partially overturned, and information about gross pay and designation was directed to be provided. (Paras 2, 9, 10)

(B) Privacy Exemptions - The balance between privacy and public interest was considered. The Commission confirmed that certain personal details are relevant in legal circumstances like maintenance cases and should not be denied outright. (Paras 9, 10)
