Rajasekaran L. – Appellant
Versus
CPIO: Indian Bank, Chennai, T. N – Respondent
Second Appeal No. CIC/IBANK/A/2024/643767
For the Appellants/Petitioners:
For the Respondents: Sreeja Rani, CM & Rep. of CPIO
RTI Act does not obligate the CPIO to provide explanations or opinions beyond existing records; queries seeking clarification are outside its scope.
Headnote:(A) Right to Information Act, 2005 - Section 2(f) - Application for information regarding account withdrawals - The appellant sought explanations and justifications from the CPIO regarding restrictions on account access - The CPIO denied the requests stating that seeking explanations does not constitute 'information' under the Act, thereby upholding the account's dormant status. (Paras 2, 8)
(B) The Commission found that the queries did not seek specific records as per the definition, hence no obligation for the CPIO to provide responses other than what was available. (Paras 7, 8)
(C) Previous judgments referenced clarify the limitations of the RTI Act regarding inferences and opinions, concluding the appeal was dismissed. (Paras 7, 8)
