Negligence by PIO in RTI compliance warrants penalty under Section 20(1) due to mala fide conduct.

Headnote:This appeal concerns a Right to Information (RTI) application seeking information on a complaint regarding certain individuals. The appellant filed an application on 02-12-2022, but no response was provided by the PIO or First Appellate Authority, prompting this appeal. The Court found that the negligence of duty by the PIO established mala fides, leading to the imposition of a penalty under Section 20(1) of the RTI Act. The key issues include whether the PIO's conduct constituted a violation of RTI provisions. The reasoning emphasized the PIO's casual approach and lack of serious compliance with RTI obligations. The final decision included a penalty of Rs. 1,000 on the then PIO for delaying information provision and the expectation of compliance with directions.
