2nd Appeal/Complaint dated : 13.05.2024 Information sought:

1. The Appellant filed an (offline) RTI application dated 24.01.2024 seeking the following information:

“1. NGO मुझे जानकारी उपलब्ध करवाई जाए संस्था सममति या मोहल्ला

सभा रजजस्टर् डकरन ेके मलए गाइर्लाइंस/प्रक्रिया है कॉपी उपलब्ध करवाई जाए

2. NGO मुझे जानकारी उपलब्ध करवाई जाए संस्था सममति या मोहल्ला

Renew सभा को करवाने की क्या गाइर्लाइंस/ प्रक्रिया है कॉपी उपलब्ध करवाई जाए

3. NGO मुझे जानकारी उपलब्ध करवाई जाए मनैं े संस्था/ सममति या

Renew मोहल्ला सभा रजजस्टर् डकरवाई थी क्या करवाना जरूरी है

4. NGO मुझे जानकारी उपलब्ध करवाई जाए अगर संस्था मोहल्ला सभा

Renew NGO को नहीं करवाई िो संस्था के खिलाफ क्या कारडवाई हो

2. Having not received any response from PIO, the Appellant filed a First Appeal dated 04.03.2024. The FAA order is Not on record.

3. Feeling aggrieved and dissatisfied, Appellant approached the Commission with the instant Second Appeal.

4. Proof of having served a copy of Second Appeal on Respondent while filing the same in CIC is not available on record.

Relevant Facts emerged during Hearing:

The following were present:-

Appellant: Absent.

Respondent: Shri P.S. Dhama, PIO-cum-SDM and Ms. Reena, DEO, attended the hearing in person.

5. The Appellant did not participate in the hearing.

6. The Respondent submitted that first reply qua the instant RTI Application has been given to the Appellant vide letter dated

10.05.2024, stating as under:

“Point No. 1,2, 3 and 5 - Please go through the provision under the Societies Registration Act, 1860 & guidelines which are available on public domain Link:

https//dmeast.delhi.gov.in/departments/registrar-of-societies-firms/

Point No. 4 & 6 - Querry/suggestion sought, hence is not covered under the ambit of RTI 2005 as per the definition of information u/s 2(F) of RTI Act, 2005.”

7. He added that First Appeal has been adjudicated by the First Appellate Authority vide order dated 25.06.2024, stating as under:

“After perusal of record, it is found that reply has been given to appellant vide letter no. 89 dated 10/05/2024, which is improper.

P'IO/SDM (HQ), District East, Delhi is hereby directed to give the revise reply of R.T.I. application as per RTI Act, 2005 within a week after receipt of this order to the appellant.

The appeal is disposed off accordingly.”

8. In compliance with the directions passed by the First Appellate Authority, a suitable reply has been given to the Appellant vide letter dated 11.07.2024, stating as under:
