1. The Appellant filed an RTI application dated 26.04.2024 before the PIO, Delhi Fire Service, seeking the following information:

“1) KINDLY SHARE THE CERTIFIED COPIES OF LAST TEN YEARS FIRE SAFETY CERTIFICATE OF BUILDING OF BEST PLAZA, H-8, PITAMPURA, NEW DELHI.

2) KINDLY SHARE THE CERTIFIED COPIES OF LAST 10 YEARS FIRE REPORT RELATED TO BUILDING OF BEST PLAZA, H-8, PITAMPURA, NEW DELHI

3) KINDLY SHARE CERTIFIED COPIES OF ENCORCHMENTS OR OBJECTS OR GOODS LIKELY FOUND TO CAUSE A RISK OF FIRE OR OBSTRUCTION TO FIRE FIGHTINGS IN BUILDING OF BEST PLAZA, H-8, PITAMPURA, NEW DELHI.

4) KINDLY SHARE CERTIFIED COPIES OF LAST DATE OF RENEWAL OF FIRE NOC OF BUILDING OF BEST PLAZA, H-8, PITAMPURA, NEW DELHI.

5) KINDLY SHARE THE CERTIFIED COPIES OF LAST TIME RENEWAL OF FIRE NOC OF BUILDING OF BEST PLAZA, H-8, PITAMPURA, NEW DELHI. WITH DATE AND TIME METIONED ON IT.

6) KINDLY SHARE CERTIFIED COPIES OF LATEST INSPECTION REPORT BY FIRE DEPARTMENT OF BUILDING OF BEST PLAZA, H-8, PITAMPURA, NEW DELHI.

7) KINDLY SHARE THE CERITIFIED COPY OF ACTION TAKEN REPORT OF LAST 10 YEARS IF BUILDING RUNNING WITHOUT FIRE NOC OF BEST PLAZA, H-8, PITAMPURA, NEW DELHI.”

2. The PIO, Delhi Fire Service responded vide reply dated 31.05.2024 stating that:

“1-7. No information available.”

3. Dissatisfied with the response of the PIO, the Appellant filed the online First Appeal dated 06.07.2024, which was decided by the FAA’s order dated 05.08.2024 upholding the PIO’s reply.

4. Aggrieved with the FAA’s order, alleging that PIO’s reply is incorrect/false/misleading, the Appellant filed the instant Second Appeal.

Facts emerging in course of Hearing:

5. Hearing was scheduled after giving prior notice to both the parties.

Appellant: Mr. Sunny, an authorised representative of the Appellant was present.

Respondent: Mr. Ravi Nath, CPIO – Delhi Fire Service was present in person.

6. The representative of the Appellant contended that the information about the Fire Safety Certificate(FSC) as sought by the Appellant has been declined by the Respondent stating that it is not available. On being asked whether he was aware of the ten appeals filed by the same Appellant, heard on 02.03.2026 and decided vide orders dated 06.03.2026, 12.03.2026 and 13.03.2026; the representative admitted he had no knowledge about the same. The attention of the representative of the Appellant was invited towards the following contents of the authorization letter dated 11.03.2026 filed by the Appellant authorising his representative to:

“• present oral and written submissions • submit documents and written submissions • seek statutory penalties and compensation make statements and clarifications receive directions and orders of the Commission Kindly permit them to appear and argue the matter on my behalf..”

However, the representative of the Appellant stated that he was not equipped/prepared to carry out any of the above mentioned tasks he had been authorised to do, and was not even aware of the background of the cases.

7. Notwithstanding the above facts, the written submission dated 11.03.2026 filed by the Appellant was taken on record, wherein he has inter alia alleged serious violations of fire safety norms, failure of statutory obligations causing risk to human life and property and administrative failure of the Respondent.
