2nd Appeal/Complaint dated : 27.08.2024 Information sought:

1. The Appellant filed an RTI application dated 05.07.2024 (online) seeking the following information:

“Under the RTI Act, we request you to provide a copy of the order in original issued in consequence of the Show Cause Notice F.No. GADT/CnG/ADT/GST/2335/2020-GR 2-CGST-ADT CIR-2-JPR-ADT-JAIPUR dated 02.06.2021 issued/passed by the Superintendent-XXXII, CGST Division-G, Sector-10, CGST Building, Jaipur-302039 against M/s Eagle Trans Shipping & Logistics Pvt. Ltd. 412, 4th Floor, Prestige Tower, Near Amrapali Circle, Vaishali Nagar, Jaipur-302021.

The information on the finality of the order after review of the order may also be provided.

If any appeal is preferred after the review of the order, the status and outcome of the same may also be provided.”

2. The CPIO furnished a reply to the Appellant on 18.07.2024 stating as under:

“कृपया उपरोÈत (cid:874)वषयाÛतगत(cid:91) आपके (cid:622)वारा आर.ट(cid:547).आई. अ(cid:876)ध(cid:467)नयम, 2005 के अंतगत(cid:91) दायर आर.ट(cid:547).आई. आवेदन पजं ीकरण सÉं या GSTJP/R/E/24/00103 जो (cid:873)क इस काया(cid:91)लय को (cid:465)दनांक 05/07/2024 को अ(cid:274)े(cid:874)षत क(cid:551) गई है का अवलोकन करने का (cid:302)म कर(cid:581)।

The requisite information falls under Section 8(1) (d) and Section 8(1) (j) of the RTI Act, 2005, therefore the requisite information cannot be provided.

Above mentioned sections are reproduced below:-

Section 8(1)(d) of the RTI Act 2005 "Information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm the competitive position of a third party, unless the competent authority is satisfied that large public interest warrants the disclosure of such information.

As per Section 8(1) (j) of the RTI Act 2005 "Information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information.

In view of above it is submitted that the requested information of applicant was rightly refused by this office.”

3. Being dissatisfied, the Appellant filed a First Appeal dated 19.07.2024.

The FAA vide its order dated 13.08.2024, passed the following observations:

“5.1 I have carefully gone through the records of the case i.e. RTI Application dated 05.07.2024 filed by the appellant, reply C. No. V(CGST)/DIV-G/07/2018-19 dated 18.07.2024 of the CPIO/Assistant Commissioner, CGST Division-G, Jaipur and the impugned appeal dated

19.07.2024.

5.2 On perusal of the RTI Application dated 05.07.2024 filed by the appellant, I find that the appellant sought the following information from the CPIO:
