1. The Appellant filed an RTI application dated 30.10.2024 seeking the following information:-

“1. Certified copies of notesheets for the case of prosecution of sanction issued in respect of Dhirendra Pratap Singh Joint Registrar along with documents submitted with notesheet to be provided.

2. Certified.copies of entire documents which were placed before the prosecution sanctioning authorities for according sanction of prosecution.

3. The certified copies of CVC advice taken before issue of order of prosecution of sanction

4. Certified copies of relevant order of concerned ministry stating competent authority for granting sanction for prosecution for Level 13 officers/ Joint Registrar in Aby IIITM GWALIOR.

5. The case already under trial in the court so documents to be provided at the earliest as the documents are urgently required to submit in court for in support of case AS THE EXCUSE OF SUBJUIDCE OF CASE IS NOT SUSTINABLE ANY MORE.

6. I am ready to pay charges as applicable for getting all the documents.”

2. The CPIO furnished a reply to the Appellant on 06.12.2024 stating as under:-

“With reference to the RTI IITGL/R/E/24/00034 dated 30.10.2024, this is to inform you that the Information as desired under RTI on dated 30.10.2024 is the same information as desired by you of your RTI dated

10.02.2022.

The same information was also desired by RTI IITGL/R/E/24/00022 dated

10.06.2024 and was replied on 08.07.2024.

Please refer to the CIC Second Appeal Order: CIC/ITGL/A/2022/620861 dated 06.06.2023, where the CIC has passed the order against your appeal filed on dated 12.04.2022 However, a letter has been sent to the SP, CBI, Bhopal on 04.11.2024 for their consent for disclosing any information to the applicant. The reply to the letter sent to CBI Bhopal is awaited.”

3. Aggrieved by the decision of the CPIO, the Appellant filed a First Appeal dated 09.12.2024. The FAA vide its order dated 31.12.2024, stated as under:-

“This is with reference to the appeal file against the RTI request no IITGL/R/E/24/00034 dated 30.11.2024.

1. As the appointing authority for Group A officials is the BoG. The BoG was appraised regarding the suspension and CBI's request for sanction for prosecution against Mr. DhirendraPratap Singh from the institute at an early date.

The BoG agreed for the same in its 45th meeting held on 22.10.2021.

2.As per the letter received from CBI Bhopal dated 16.12.2024, the information is exempted under section 81 (h) of RTI Act 2005.

3.The sanctioning authority is the BoG, hence the CVC advice not required.

4.The Ministry representative is one of the member of the BoG, the BoG granted sanction for the prosecution for level 13 (Group A) Officer in its

45th meeting held on 22.10.2021.”

4. Challenging the FAA’s order, Appellant is before the Commission with the instant Second Appeal.

Relevant Facts emerged during Hearing:

The following were present:-

Appellant: Shri D. P. Singh, present through video conference.

Respondent: Shri Raj Kumar, Dy. Registrar/CPIO present through video conference.
