1. The Appellant filed an RTI application dated 19.09.2024(offline) seeking the following information:

“1. Please furnish the name of the issuing Body/Department/Ministry of Central/State Government which issues the Guidelines and Notifications/Circulars/Manuals pertaining to handling of Medico-Legal Cases in jurisdiction of Gujarat State.

2. Please arrange to furnish the Certified copy of the latest full version of the Medico-Legal Manual of Standard Operating Procedures (SOP), including the certified copy of specimen copies of all the pertaining examination reports, certificates, reports, forms thereto, prevalent and in force at AIIMS Hospital, Rajkot.

3. Please confirm whether the Medico-Legal manual as sought through Point No.2 is applicable to all the Competent Hospitals or only Government Hospitals across the State of Gujarat. (Please arrange to give answer in YES/NO)

4. Please arrange to confirm whether all the Competent Hospitals across the State of the Gujarat are obliged to handle all the Medico-Legal Cases strictly as per the guidelines depicted in the Medico-Legal manual as sought through Point No.2.(Please arrange to give answer in YES/NO)

5. Please arrange to provide the download link of the Medico-Legal Manual sought vide point no.2, if the same is available online.

6. Please furnish all the criteria required to be satisfied in order for a case to be qualified as a Medico-Legal Case.

7. Please furnish the Designation of the officer/Personnel of the GMERS Hospital, Gotri, Vadodara, who is authorized to label and handle the case as a Medico-Legal Case.

8. Please furnish the list of Types of cases qualified to be labelled as Medico-

Legal Cases.

9. Please furnish all the Manuals/Circulars/Notifications issued to GMERS Hospital, Gotri, Vadodara, (Other than the Medico-legal Manual sought in Paint No.2) depicting guidelines to be followed on registration and handling of the Medico-Legal Cases as effective of 19/09/2024.

10. Please furnish the guidelines pertaining to the maximum period within which Medico-legal Report (MLR) pertaining to a Medico-Legal Case shall be filled, issued and kept in record after the subject case has been labelled as a Medico-

Legal Case.

11. Please confirm whether Domestic Violence is qualified to be labelled as a Medico-Legal Case. (Please arrange to give answer in YES/NO)

12. Please furnish the protocol/ standard operating procedure including the assessment/evaluation of the patient mandatorily to be followed by Authorized Designated personnel of the Hospital attending such case prior to and after being labelled as Medico-Legal Case under Domestic violence.”

2. The CPIO furnished a reply to the Appellant on 25.10.2024 stating as under:

3. Being dissatisfied, the Appellant filed a First Appeal dated 26.10.2024. The FAA vide its order dated 06.11.2024, held as under:
