2nd Appeal/Complaint dated : Nil Information sought:

1. The Appellant filed an RTI application dated 24.07.2024 seeking the following information:

“In the Advt. No. IIITDMK/Rect./NTS/2021/03, dated 03-11-2021. For the post of Assistant Registrar, 1. Request to provide the Level-1, Level-2, and interview marks of all the candidates shortlisted for the final stage of Assistant Registrar.

2. As per the CIC order File No: CIC/NHICL/2020/13371 dated: 31/03/2022 in the matter of Maran Sarkar Vs NHICL, the Individual Name, Address, marks, and professional records are considered as Personal Information. But, on what basis IIITDM Kurnool has shared my Name, Address and professional records with the Advocate M.D.V Jogaiah Sarma, which is threatening the safety of my family members?

3. As per the RTI Act 2005, Section 4 (viii), I request to provide all the minutes of meetings of the committees constituted in the recruitment of Assistant Registrar.

4. According to which rule position, cutoff marks for Level-1 and Level-2 are decided? 5. Noting and drafting for the decisions taken in the recruitment process of Assistant Registrar are preserved or not?

6. Request to provide all the noting and drafting of the decisions taken in the recruitment process of the Assistant Registrar.

7. Till how many days, the answer sheets/ scripts of the Assistant Registrar post will be preserved?

8. Did the IIITDM Kurnool record the interview process for the Assistant Registrar recruitment?

9. If the interview process of Assistant Registrar is not recorded, I request to provide the reason behind not recording the interview process.

10. I request to provide clear details, on how my Leave Encashment has been calculated.”

2. The CPIO furnished a reply to the Appellant on 22.08.2024 stating as under:

1. The question asked was repetitive in nature as the same question was asked by Sh. D Raviteja vide RTI no. MEADP/R/E/22/00037 dated 27.08.2022 and the reply was already given to individual on 19.09.2022. As per CIC vide its decision no. CIC/AD/A/2013/001326-SA dated 25.6.2024 stated that :

(a) No Scope of repeating under RTI Act (b) Citizen has no right to repeat However the reply given is once again furnished for your reference:

The information sought cannot be provided since this information is considered personal vide CIC order file no: CIC/NHICL/2020/13371 dated 31.3.2022 in the matter of Maran Sarkar Vs National Highways and Infrastructure Development Corporation Limited, the operative part of which is as under:

“Reading of the aforesaid judicial precedents, in our opinion, would indicate that personal records, including name, address, physical, mental and psychological status, marks obtained, grades and answer sheets, are all treated as personal information. Similarly, professional records, including qualification, performance, evaluation reports, ACRs, disciplinary proceedings, etc. are all personal information. Medical records, treatment, choice of medicine, list of hospitals and doctors visited, findings recorded, including that of the family members, information relating to assets, liabilities, income tax returns, details of investments, lending and borrowing, etc. are personal information.
