2^ndAppeal/complaint received on : 02.11.2023 Information sought and background of the case:

The Appellant filed an RTI application dated 17.07.2023 seeking information on the following points:-

“I had sought information related to condonation in the month of September 2022 at the Center through RTI, in response to which information was provided on June 5, 2023, I was informed that the office record on the edge from January 2022 to March 2023 is not in any office. This type of work of condemnation has not been done, then it is definitely natural that 100 present old records of the office may be safe and available.

A Please provide the following information regarding the intake files of the clients who came to the center between January 2000 to December 2013 and camp intake seats of the same period, please make available below A 1 Any five Intake sheets photo copy related to registration of pwd clients in camps organized every month of same duration as above will be provided A-2. Intake no 01 OH 2000 to 2013 photo copy of each one file of each month will be provided from the Intake related files of PWD clients coming to the center for the period referred to above.

B. Please make a declaration in yes or no about the real fact that the record is still available in the referral section of above said mentioned period.

C. Please make available Daily attendance register record of Mr Gautam Kumar Mukharji, Ex HOO from the period of November 2022 to 30^th April 2023.”

Having not received any response from the CPIO, the Appellant filed a First Appeal dated 16.08.2023 which was not adjudicated by the FAA as per available records.

Meanwhile, the CPIO, Ministry of Labour & Employment, New Delhi vide letter dated

28.08.2023 replied as under:-

“1.आपकी सूचना कंमांक 1 एवं 2 केन्द्र में स्वच्छ भारत अभभयान में भिनांक 07.09. 2022 को Weed-out के तहत पुराने ररकार्ड यथा केन्द्र प्रवेश पत्रावली व कैम्प प्रवेश पत्रावभलयों का भनस्तारण केन्द्र के श्री बी. के. शमाड, कररयर सहायक की िेखरेख में भकया जा चुका है तथा Weed-out के उपरान्त रखे जाने वाले ररकार्ड के रुप में संग्रभहत है। अतः *चाहे गये समय अवभि की सूचना भजस रूप में चाही गई है, उपलब्ध नही है।

2. आपकी सूचना कंमांक - B सूचना का अभिकार अभिभनयम 2005 के तहत भकसी प्रकार की सलाह सुझाव अथवा हााँ या ना में घोषणा करने का प्राविान नही है।

3. आपकी सूचना कमांक श्री गौतम कुमार मुखजी, पूवड कायाडलय प्रमुख इस केन्द्र से स्थानान्तररत हो चुके है। इस केन्द्र के ऑनलाईन उपस्थस्थभत ररकार्ड से उन्हें ट्रान्सफरआउट् भकया जा चुका है। भजससे उनसे सम्बस्थित उपस्थस्थभत का ररकार्ड चतडमान में इस कायाडलय में चाही गई समय अविी की उपस्थस्थभत की सूचना उपलब्ध नहीं है।”

Aggrieved and dissatisfied, the Appellant approached the Commission with the instant Second Appeal.

Facts emerging in Course of Hearing:

A written submission dated 20.01.2025 has been received from the CPIO, National Career Service Centre for Differently Abled, Jaipur reiterating the above facts about the reply dated 28.08.2023 duly sent by the Respondent.

Hearing was scheduled after giving prior notice to both the parties.
