CORAM:

Hon’ble Commissioner

_ANANDI RAMALINGAM

O R D E R

1. The Appellant filed an RTI application dated 02.08.2024 seeking information on

the following points:

1. I was a HDFC bank customer for many years. Hence, by custom and mandate, we

had to register our Mobile contact numbers for Official communications. Over the

past, I had registered following Mobile numbers with HDFC Bank.

1) ******3495

2) ******1054 Very unfortunately, we were TORTURED with HUGE

UNSOLICITED COMMERCIAL CALLS by HDFC Bank Telecalling agents in the

recent past many years on both the above numbers.

Hence, without choice, I was forced to forego my Mobile connection ******3495

since more than 1 year now DUE TO HEAVY VOLUME AND BARRAGE OF

UNSOLICITED COMMERCIAL CALLS.

HAVING SAID, THE UNSOLICITED COMMERCIAL CALLS FLOW DID NOT

STOP AT THE OTHER NUMBER ******1054 TOO, TILL THIS DATE, WE ARE

BEING CALLED BY VARIOUS HDFC BANK TELECALLING AGENTS AND

BEING REPORTED.

In this regard, we had registered MANY complaints in the past years WITH,

1) HDFC Bank

2) RBI OMBUDSMAN, even done recently

3) Ministry of Finance

4) Ministry of Telecommunications…

….HENCE, WE ARE APPROACHING YOUR GOOD OFFICE TO HELP US IN

THIS MATTER BY DIRECTING HDFC BANK TO SHARE STATUSES OF ALL

POLICE COMPLAINTS LODGED BY THEM AGAINST OUR UCC GRIEVANCE

IN ALL THESE YEARS FOR BOTH ABOVE MOBILE NUMBERS. WE HAVE

ATTACHED EMAILS RECEIVED FROM HDFC AND SAMPLE POLICE

COMPLAINTS LODGED BY HDFC BANK.

2. The CPIO replied vide letter dated 14.08.2024 and the same is reproduced as

under :-

“The applicant is seeking the initiation of action, which does not come under the

purview of the Right to Information Act, 2005.

We have no information in this regard.

You may also note that the grievance redressal of the RBI is an alternate dispute

resolution mechanism.”

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First

Appeal dated 17.08.2024 alleging that the information provided was incomplete, false

and misleading. The FAA vide order dated 27.09.2024 upheld the reply given by the

CPIO.

4. Aggrieved with the FAA’s order, the Appellant approached the Commission with

the instant Second Appeal dated 01.10.2024.

5. The appellant remained absent and on behalf of the respondent Dattarey Ingale,

Asst. Manager, Abhishek Kumar, Legal Officer & Ms. Kanika, Assistant Manager,
