1. The Appellant filed an RTI application dated 10-04-2024 seeking the following information:

“आपके (cid:554)ारा ঋेिषत पআांक संূा 20230800619/C/V3/C/ALD के साथ संल্ फाम१ की सभी शत९ (cid:738)ीकार कर ঋाथ५ ने जांच म७ पूण१ सहयोग करते ॽए जांच अिधकारी एवं आपको (঒ीमान महाঋबंधक िविजल७स) िल्खत बयान, सभी साশ (संबंिधत द(cid:721)ावेज, फोटो व वीिडयो) ঋ(cid:721)ुत करने के साथ ही रिज(cid:720)ड१ डाक से ঋेिषत िकए। साथ ही ঋाथ५ ने जांच आূा से अवगत कराने का िनवेदन भी िकया

था। उঢ जांच ौरपोट१ की ঋाथ५ को आव(cid:692)कता है ভोिंक ঋाथ५ को माननीय (cid:586)ायालय म७ ঋेिषत करना है। अतः आपसे ঋाथ१ना है िक उঢ ঋकरण म७ ॽई संपूण१ जांच की ঋमािणत ঋितयां ঋदान करने की कृपा कर७। ”

2. The CPIO furnished a reply to the Appellant on 24-04-2024 stating as under:

“सूचना का अिधकार अिधिनयम, 2005 के अंतग१त आर.टी.आई. वेब साइट के मा(cid:559)म से िदनांक 18.04.2024 को ঋा(cid:593) आपके आवेदन िदनांक 10.04.2024 म७ 'उ(cid:517)र म(cid:559) रेलवे सतक१ता िवभाग' से संबंिधत जानकारी के संबंध म७ आपको अवगत कराया जाता है िक आपके (cid:554)ारा की गई िशकायत पर जांच के दौरान िशकायत म७ लगाया गया आरोप साশ के अभाव म७ िस(cid:544) नही ंपाया गया िजसके

पौरणाम(cid:738)ॺप िशकायत को इस काया१लय म७ ब(cid:573) कर िदया गया है।”

3. The Appellant filed a First Appeal dated 22-05-2024. The F.A.A upheld the reply of C.P.I.O vide order dated 06-06-2024 with following observations:

“आपके मूल आवेदन (cid:465)दनाकं 10.04.2024 (जो क(cid:551) इस काया(cid:91)लय म(cid:581) वेबसाइट के माÚयम स े अनुरोध संÉया NCRLY/R/P/24/00082 (cid:465)दनाकं 18.04.2024 के (cid:622)वारा (cid:292)ाÜत हुआ था) कर जवाब इस काया(cid:91)लय के प(cid:287) सं. सत/उमरे/आर.ट(cid:547).आई.पी.एस.आर./945/24 (cid:465)दनाकं 24.04.2024 के (cid:622)वारा आपको (cid:292)(cid:874)ेषत (cid:873)कया जा चुका है। इसी (cid:272)म म(cid:581) आपक(cid:551) ऑनलाइन अपील (जो इस काया(cid:91)लय म(cid:581) वेबसाइट के माÚयम से अनुरोध संÉया NCRLY/A/P/24/00011 (cid:465)दनाकं 04.06.2024 के (cid:622)वारा (cid:292)ाÜत हुआ है) पर (cid:874)वचार (cid:873)कया गया एव ंयह पाया गया (cid:873)क जन सूपना अ(cid:876)धकार(cid:547) (सतक(cid:91)ता) (cid:622)वारा आपके मूल आवेदन म(cid:581) इस काया(cid:91)लय से संबिÛधत मांगी गई सूचना आपको उपरोÈत प(cid:287) (cid:622)वारा पहले ह(cid:547) भजे ी जा चुक(cid:551) है तथा इस काया(cid:91)लय से संबिÛधत भेजी गई सूचना यथो(cid:876)चत है। साथ ह(cid:547) यह भी आपको बताया जाता है (cid:873)क आपके (cid:622)वारा मांगी गई सूचना RTI Act, 2005 के पारा 8 (1) (g) एव ं 11(1) के तहत देय नह(cid:547) ंहै तथा िजसे CIC के (cid:467)नणय(cid:91) सÉं या -CIC/SB/A/2016/000848-BJ (cid:465)दनांक 31.01.2017 म(cid:581) भी देय नह(cid:547) ं

माना गया है।“

4. Feeling aggrieved and dissatisfied, Appellant approached the Commission with the instant Second Appeal.

Respondent: Shri Gunjan Srivastava, Deputy Chief Vigilance Officer (Engineering) & AR of CPIO present through Video-Conference.

5. Proof of having served a copy of Second Appeal on Respondent while filing the same in CIC on 01.07.2024 is not available on record.

Respondent confirms non-service.

6. The Appellant, during the hearing, reiterated the contents of his RTI application and instant appeal and submitted that till date complete and correct information has not been provided to him by the Respondent.
