Information sought:

1. The Appellant filed an (online/offline) RTI application dated 23-03-2024 seeking

the following information:

(1) Mrs. Sangeeta Chakraborty, wife of late Shri Sameer Chakraborty,

former LDC, was appointed on compassionate grounds on the

post of MTS in the Principal Director, Defence Estates, Ministry of

Defence, Eastern Command, Kolkata. Kindly provide the attested

copy of the appointment letter.

(2) How many times clarification letters were issued to Mrs. Sangeeta

Chakraborty, MTS by the Principal Director, Defence Estates,

Ministry of Defence, Eastern Command, Kolkata during her

tenure? Kindly provide the attested copy of all the clarification

letters issued.

(3) In the light of the letter of explanation given to Mrs. Sangeeta

Chakraborty MTS by the Principal Director Defence Estates,

Ministry of Defence, Eastern Command, Kolkata, please provide

the attested copy of the reply given by Mrs. Sangeeta Chakraborty

MTS.

(4) Mrs. Sangeeta Chakraborty MTS was dismissed from the job by

the Principal Director Defence Estates, Ministry of Defence,

Eastern Command, Kolkata. Please provide the attested

copy of the dismissal letter.

(5) A POSH Committee was constituted against Mrs. Sangeeta

Chakraborty MTS by the Principal Director Defence Estates,

Ministry of Defence, Eastern Command, Kolkata. Please provide

the attested copy of the names and designations of the officers

who were in the said POSH Committee.

(6) A POSH Committee was constituted against Mrs. Sangeeta

Chakraborty MTS by the Principal Director Defence Estates,

Ministry of Defence, Eastern Command, Kolkata. Please provide

the attested copy of the decision taken in the POSH Committee.

2. The CPIO furnished a reply to the Appellant on 02-05-2024 stating as under:

3. Being dissatisfied, the appellant filed a First Appeal dated 09-05-2024. The FAA

vide its order dated 07-06-2024 held as under:

“

(1) Whereas a First Appeal cited under reference against CPIO reply dated

02.05.2024 has been received through online RTI Portal from Shri Ashish

Kumar Sharma, Vill-Achhaiya, PO-Ordana, District - Bokaro, Jharkhand -

829121, w.r.t is RTI application (PDDEK/A/E/24/00004) dated 09.05.2024.

The said reply to the appellant was communicated by CPIO (Adm) of Dte.

DE, EC, Kolkata through online RTI portal on 02.05.2024.

(2) In this connection records were called for from the CPIO (Admin) and after

examination of the matter in light of records available on file as well as

statements of the CPIO, it is revealed that the Appellant has requested to

provide the attested copy of all the documents in respect of Smt. Sangeeta

Chakraborty, EX-MTS of PD DE, EC, Kolkata vide his RTI application dated

03.04.2024. However, CPIO stated that as the attested copies of the desired

documents are not available on record same could not be supplied by him.

Accordingly, the RTI appeal (PDDEK/A/E/24/00004) dated 09.05.2024 is

hereby disposed off.”

4. Feeling aggrieved and dissatisfied, appellant approached the Commission

with the instant Second Appeal.
