O R D E R

1. The Appellant filed an RTI application dated 20.12.2023, before the CPIO, Power Development Department, UT of J & K seeking information as under:

“1. Copy/copies of the Vigilance Clearance received from GAD by the PDD in respect of the I/C Chief Engineers (Electrical) as Chief Engineer (in regular pay scale),

whose names figure in Govt. order No. 51-JK(PDD) of 2022 dated 22.04.2022.

2. Copy/copies of the Vigilance Clearance received from GAD by the PDD in respect of the I/C Superintending Engineers (Electrical) as Superintending Engineer (in

regular pay scale) whose names figure in Govt. order No. 50-JK(PDD) of 2022 dated

22.04.2022.

3. Copy/copies of the Vigilance Clearance received from GAD by the PDD in respect of the I/C Superintending Engineers (Electrical) as Superintending Engineer (in regular pay scale) whose names figure in Govt. order No. 187-JK(PDD) of 2021 dated

18.11.2021.

4. Copy/copies of the Vigilance Clearance received from GAD by the PDD in respect of the I/C Executive Engineers (Electrical) as Executive Engineer (in regular pay

scale) whose names figure in Govt. order No. 186-JK(PDD) of 2021 dated 18.11.2021.

5. Copy/copies of the Vigilance Clearance received from GAD by the PDD in respect of the I/C Executive Engineers (Electrical) as Executive Engineer (in regular pay

scale) whose names figure in Govt. order No. 49-JK(PDD) of 2022 dated 22.02.2022.”

2. Alleging non-receipt of a reply to the RTI Application, the Appellant filed a First Appeal dated 26.02.2024. Subsequently, the CPIO & DS replied to the RTI Application

vide letter dated 29.02.2024, as under:

“With reference to your RTI application regarding the subject cited above, it is to inform you that the information sought by you comes under the purview of third party information, as such, it cannot be provided to you in terms of Section 11 of RTI Act, 2005.” 3. The FAA & AS, Power Development Department, UT of J & K vide order dated

01.04.2024 held as under:

“3. Another appeal for the RTI Application filed on 20.12.2023 by the appellant was also clubbed with this appeal, as the information sought by the appellant was associated

with the first application seeking the following information.

I. Copy of UO No. GAD-CORD/77/2022 dated 19.04.2022, in respect of regularization of I/c Chief Engineers (electrical) as Chief Engineers (electrical)

PDD.

II. Copy of UO No. GAD-CORD/77/2022 dated 19.04.2022, in respect of regularization of I/c Superintending Engineers (electrical) as Superintending

Engineers (electrical) PDD.

PDD.

4. It has been noted that during the currency of the RTI applications intervening period, the PIO/CPIO of the department got transferred and a new CPIO has taken over.
