Facts of the case:
The Appellant filed RTI applications seeking the high school mark sheet and certificate details of a third party, alleging fraud regarding the third party's date of birth and documents. The authorities denied the request, stating the information belongs to a third party and is exempt from disclosure under the Right to Information Act.

Findings of Court:
The Commission found that the requested information pertained to personal records of a third party and that the grounds provided by the Appellant regarding a criminal complaint did not fall under the mandate of the RTI Act to override the privacy exemption.

Information sought:

1. The Appellant filed an RTI application dated 17.11.2024 before CPIO, CBSE, Prayagraj seeking the following information:

“विषय: सूचना अधिनियम 2005 की धारा 6 (1) के अन्तर्गत निम्न व्यक्ति की सूचना उपलब्ध कराने के संबंध में- नाम : अरविन्द कुमार पाठक, पुत्र श्री धर्मात्मा पाठक, हाई स्कूल अनुक्रमांक- 5127611, उत्तीर्ण वर्ष-1993, स्कूल- एच.ए.एल. स्कूल, अयोध्या रोड (फैजाबाद रोड), लखनऊ, बोर्ड केन्द्रीय माध्यमिक शिक्षा बोर्ड (CBSE) सेकेंडरी स्कूल परीक्षा, 1993

1. उक्त व्यक्ति की हाईस्कूल मार्कशीट व हाईस्कूल सर्टिफिकेट में दर्ज जन्मतिथि की प्रमाणित प्रति प्रार्थी को उपलब्ध कराएं।

2. उक्त व्यक्ति को हाईस्कूल बोर्ड परीक्षा में विषयवार (लिखित व प्रायोगिक) कितने अंक प्राप्त हुए (अंक व शब्द में) की प्रमाणित प्रति प्रार्थी को उपलब्ध कराएं।

मांगी गई सूचनाएं (क्रमांक 1 व 2) अधिनियम की धारा (8) के अन्तर्गत नहीं आती है।“

2. The CPIO furnished a reply to the Appellant on 28.11.2024 stating as under:

“क्षेत्रीय कार्यालय, प्रयागराज, के पत्र क्रमांक के. मा.शि.बो./ क्षे.का./प्रया./सू.अ.अ./फ.235.-/ 2024 दिनांक 28.11.2024 जिसमे उल्लेखित है कि श्री सुनील गुप्ता (अधिवक्ता), निवासी लखनऊ का आवेदन दिनांक 17.11.2024 उनके कार्यालय के डायरी संख्या 22317 दिनांक 21. 11.2024 को प्राप्त दर्ज है, जिसमे आवेदक द्वारा मांगी गई जानकारी अरविन्द कुमार पाठक अनुक्रमांक 5127611, वर्ष 1993 से है जो क्षेत्रीय कार्यालय अजमेर के आधीन था। अतः आवेदन को सूचना अधिकार अधिनियम 2005 नियम 6 (3) के अनुसार आपको आवश्यक कार्यवाही हेतु अग्रेषित किया जा रहा है। अतः कृपया इस कार्यालय को सूचित करते हुए जवाब सीधे प्रार्थी को देने का कष्ट करें।

चूँकि उक्त वर्णित पत्र क्षेत्रीय कार्यालय, अजमेर में प्राप्त नही हुआ, इसलिए जवाब प्रेषित नही किया जा सका।”

3. The CPIO, CBSE, RO, Prayagraj forwarded the RTI application to the CPIO, CBSE, Ajmer on 28.11.2024 for providing the information directly to the Appellant.

4. Aggrieved by the decision of the CPIO, the Appellant filed a First Appeal dated 30.12.2024 before the FAA, CBSE, RO, Ajmer. The FAA vide its order dated 27.01.2025, stating as under-

“आपका प्रथम आवेदन इस कार्यालय में स्थानांतरित होकर प्राप्त नही हुआ इसलिए जवाब प्रेषित नही किया गया। फिर भी आपकी प्रथम अपील में वांछित जानकारी के सन्दर्भ में सूचित है कि चाही गई जानकारी सूचना अधिकार अधिनियम 2005 के अंतर्गत तृतीय पक्षकार की गोपनीय सूचना है। तृतीय पक्षकार की बिना पूर्वानुमती / सहमति के किसी भी प्रकार की सूचना उपलब्ध नहीं कराई जा सकती है। अतः आपकी अपील को सूचना अधिकार अधिनियम की धारा 8(1) (J) के अंतर्गत निस्तारित की जाती है।“
