O R D E R

1. The Appellant filed an RTI Application dated 26.08.2024, before the CPIO,

Education Department, GNCTD, seeking information as under:

2. The Appellant received a reply on 23.09.2024 through the RTI online portal as

under:

“RTI application has been forwarded to concerned HOS (being APIO) under Zone-

15 with the directions to supply the information under RTI ACT directly to the applicant.”

3. The Principal, Sarvodaya Co-Ed Sr. Sec. School, Jaidev Park, New Delhi addressed

the DDE, Zone 15, Karampura, vide letter dated 24.09.2024, stating in respect of the

instant RTI Application that the same is not related to their department, which is also

placed on record.

4. Subsequently, the Appellant filed a First Appeal on 26.09.2024 before the FAA

reiterating the RTI queries. The FAA/RDE (West) vide order dated 16.10.2024 held as

under:

“In response to above notice, PIO/DDE (Zone-15) has submitted vide letter No.

1086 dated 05.10.24 that the RTI application had been transferred to concerned HOS

(being APIO), further the APIO (HOS, S.V., Jaidev Park 1515001) has replied to the

applicant vide Ref. No. SV/JDP/2024/551 dated 24/09/2024.

After going through the RTI appeal and submissions made by the appellant, it

appears that the information sought is exempted from disclosure under Section 11 of the

Act. It is a settled fact that the copy of Caste Certificate of a third party is personal

information of that third party" as per CIC order in Madhu Vs PIO and Sr. DMM, DRM

Office, Northern Railways dated 05/12/2017. The Appellant did not provide any cogent

reason to demonstrate the involvement of a larger public interest in the case.”

5. Aggrieved with the FAA’s order, the Appellant approached the Commission with

the instant Second Appeal on 28.10.2024, urging that the information pertains to a public

record and relying upon earlier decisions of CIC on related subject matter.

Hearing Proceedings & Decision

6. The Appellant was present during the hearing in person. On behalf of the

Respondent, Praveen Kumar Kalra, CPIO & DDE (West) along with Vinod Kumar,

Principal, S.V JAIDEV Park attended the hearing in person.

7. The Appellant stated that he has sought to ascertain the veracity of the caste

reservation benefit availed by the averred employee of the School. In addition to the CIC

decisions relied upon in his grounds of second appeal relating to 2009, the Appellant

sought to rely on a recent CIC decision dated 15.04.2025 in File No.

CIC/NGTRI/A/2023/65326. Upon a query from the Commission, the Appellant affirmed

that he is not related to the averred employee in any manner.

8. The Respondent relied upon the decision of the FAA to state that the information

sought pertains to the personal information of a third party. Further, the Commission took
