1. The Appellant filed an RTI application dated 15-08-2024 seeking the
following information:
“Request for Detailed Explanation of Denial of Retirement on Medical Grounds.I have
been on leave without pay from EIL due to my medical condition, keratoconus
(ectasia), which significantly impairs my vision. I had intimated and requested for the
separation on medical grounds on 23rd Aug 2023. Despite consulting several
reputable doctors, I have received differing opinions, making it difficult to pursue
treatment without considerable risk. The doctors have specifically mentioned that no
surgery is recommended in my eyes and use of spectacles and special scleral lenses
are also not helping treat my situation. The request for special lenses was also denied.
Unable to perform my work duties, I applied for retirement on medical grounds, but
the company EIL has denied my request citing that my request does not meet the
criteria. The request very much meets the criteria as per my understanding. CI 3.1 of
EIL rules on premature retirement on medical grounds as below.
3.0 CRITERIA FOR EFFECTING PREMATURE RETIREMENT AND PROCEDURE
3.1 An employee on the permanent rolls of the Company may be offered or he/ she
may himself/ herself apply to HR Department for premature retirement on medical
grounds in the proforma enclosed as Annexure-I in any of the following circumstances:
(a) When an employee has been continuously on Leave without Pay on medical
grounds for a period of preceding 12 weeks (including Sundays, holidays and other
closed days).
(b) When an employee has been on Leave without Pay on medical grounds for a total
period of 120 days (including Sundays, holidays and other closed days) or more, during
a continuous period of preceding six months.
(f) When an employee owing to physical or mental infirmity or deterioration in general
health is unable to effectively discharge his/her duties.
I respectfully request the following information:
-A detailed explanation of the specific reasons for the denial of my retirement
application on medical grounds.
-Any specific criteria or medical assessments that were considered during the decision-
making process.

##PAGE3##-Copies of any reports, assessments, or documentation that were used to evaluate my
application.
-Information on any appeal process or further steps I can take to contest this decision.”
2. The CPIO furnished a reply to the Appellant on 11-09-2024 stating as
under:
“This has reference to your RTI application received in this office.
In this regard, our point wise reply is provided below:-
1. Query is not a request for information, rather is a clarification/explanation in nature
and hence excluded from the purview of the RTI Act.
2. The matter was reviewed in line with the rules governing premature retirement on
medical grounds, available on EIL connect.
3. Medical reports submitted by Ms Neha Wadhwa Arora.
4. Query is not clear.”
3. Being dissatisfied, the Appellant filed a First Appeal dated 07-10-2024.
The FAA vide its order dated 04-11-2024, held as under:
“As Appellate Authority, I have gone through submission made in the RTI Appeal in
conjunction with the reply provided in RTI application.
