Information sought:
1. The Appellant filed an RTI application dated 12.07.2024 (online) seeking
the following information:

##PAGE2##“In public interest and safety with respect to fire incidences recently took
place in Nai Sarak and Bhagirath Palace fires in 2022, I seek information
regarding the compliance of the Unified Building Bye-Laws (UBBL) 2016
for a property located at 2145 A, Chah Indara, Dr H C Sen Marg,
Fountain, Chandni Chowk, Delhi for the period since the bye laws came
into force. The specific details are as follows:
1. Permitted Height:
Information on the permitted height for residential buildings in Chandni
Chowk and whether the property complies with the height restriction of
not exceeding 15 meters or ground plus four upper stories, including the
mezzanine floor.
2. Fire Safety Compliances:
Details of the fire safety compliances for the property, specifically:
a) Access to the building for fire services.
b) Adequate number, width, type, and arrangement of exits.
c) Installation of fire detection and alarm systems.
d) Provision of fire extinguishers on each floor.
e) Adequate and reliable water supply for firefighting.
f) Installation of emergency lighting in corridors, exits, and staircases.
g) Design and maintenance of staircases for emergency evacuation.
3. Godown Use (As property’s first and ground floors are apparently on
rent)
Information on the allowed storage classes and area limitations for the
property, specifically regarding:
a) Storage of non-hazardous items.
b) Special permissions required for flammable and hazardous materials.
c) Total covered area for storage not exceeding 250 square meters.
d) In case of fire incidences, what are the fire compliances with respect to
which, renting out of godowns must be taken care of with respect to
specifically non inflammable and hazardous materials. Does the above
property comply with the criteria in this regards for renting out its
premises for the materials. What are the items for which the
godowns/shops have been rented out for? Are these items safe in the
public interest?
4. Construction Compliances for Each Floor
Details of construction compliances for each floor of the property,
specifically:

##PAGE3##a) Compliance of partition walls with the provisions of other bye-laws.
b) Projections onto public land.
c) Roof projections and their inclusion in FAR calculations.
d) Compliance of front balconies enclosed by Jali walls used as part of
staircases.
5. General
e) Details of compliances for low hanging wires of several service
providers at the property, how are these safe for the anticipated fire
incidences and safety of neighbourhood and the market area.
f) Whether any of the safety audit reports in last 20 years had collected
any sample from the above property. If yes, extract of the same may be
made available.
Reply in soft copy is preferable as it reduces waste of papers and hence
no loss to environment.”
2. The CPIO furnished a point-wise reply to the Appellant on 16.08.2024
stating as under:
“1. No such information in respect of property no. 2145-A, Chah Indara,
Dr. H.C. Sen Marg. Fauntain, Chandni Chowk, Delhi is available in the
