Information sought:

1. The Appellant filed an RTI application dated 12.06.2024 (offline) seeking the following information:

“आय सेअधक अिजत सपय क गयी शकायत द. 29-4-2024 का संदभ हण कर ।

"नवेदन के साथ कहना है'क म ुझ +ाथ, -वारा ./टाचार के मामलेम द. 29-4-2024 को सा4य सहत शकायत +ाथना प5 व शपथ प5 6ीमान "नदेशक महोदय, +वतन "नदेशालय नई द8ल9 को +ेषत 'कया था, जो +वतन "नदेशालय को द. 3-5-2024 को +ा;त हो गया हैउ=त के सब?ध म सूचना अधकार 2005 केअ?तगत सूचना उपलAध करानेका क/ट कर ।

1- यह 'क म ुझ +ाथ, -वारा मथ ुरा व?दावन ृ वकास +ाधकरण-मथ ुरा (उ.+.) के ./ट लोक सेवको -वारा ./ट आचरण सेआय सेअधक अिजत क गयी सपय के सबंध म , द. 29-4-2024 को 6ीमान जी को +ेषत 'कयेगये शकायत +ाथना प5 पर =या कोई कायवाह9 क गयी हैयद हां तो उ=त के सबंध म प5 सहत सूचना उपलAध करानेका क/ट कर । छाप +"त केसाथ,

2- यह 'क म ुझ +ाथ, -वारा द. 29-4-2024 को +वतन "नदेशालय नई द8ल9 को +ेषत 'कयेगयेशकायत +ाथना प5 पर +वतन "नदेशालय -वारा उ=त +करण क जांच कायवाह9 के लए 'कस अधकार9 को "नदEशत 'कया गया है, िजसक सूचना उपलAध करानेक क ृ पा कर ।

अतः 6ीमान जी से+ाथना है'क उपरो=त मामलेक सूचना उपलAध करानेक क ृ पा कर । मामला ./टाचार का है, सूचना देय है। आवेदक गर9बी रेखा के नीचे जीवन यापन करता है। सूचना "नःश8क ु देय है। गर9बी रेखा के राशन काडक छाया+"त संलIन है। जैसा 'क ./टाचार मामलेम मा. उJच ?यायालय नई द8ल9 ने WP(C) 2033 व CM APPL 4957/2020-44582/2020 के "नणय म सी.बी.आई. के सी.पी.आई.ओ. को सूचना उपलAध करानेका "नदEश दया गया है अतः सूचना उपलAध करायी जावे।”

2. The CPIO furnished a point-wise reply to the Appellant on 19.07.2024 stating as under:

“1. उपरो=त के संबंध म आपका Lयान सूचना का अधकार अध"नयम, 2005 क धारा 24 क ओर आकषत 'कया जा रहा जो 'क "ननवत है: -

इस अध"नयम म अ?तद/ट कोई बात, के ?N9य सरकार -वारा Oथापत आसूचना और सुरQा संगठन को, जो दसर9 ू अन ुसूची म व"नद/ट हS, या ऐसे संगठन -वारा उस सरकार क द9 गई 'कसी सूचना को लागूनह9ं होगी। +वतन "नदेशालय वैसा ह9 एक संगठन हैिजसका वणन दसर9 ू अन ुसूची के पंचम पंि=त म है। ।।. सहपठत धारा 8 (ज) म यह बताया गया है'क "सूचना िजसके +कट करनेसेअ?वेषण या अपराधय के गरVतार करनेया अभयोजन क 'Wया म अड़चन पड़ेगी"

2. अतः उपरो=त के संबंध म आपको सचत ू 'कया जाता है'क सूचना का अधकार अध"नयम, 2005 क धारा 24 एवंसहपठत धारा 8 (ज) के अंतगत द9 गई छूट के (आधार पर) आपके -वारा मांगी गयी उ=त जानकार9 आपको +दान नह9ंक जा सकती है।”

3. Being dissatisfied, the Appellant filed a First Appeal dated 10.08.2024. The FAA’s order is not on record.

4. Feeling aggrieved and dissatisfied, Appellant approached the Commission with the instant Second Appeal.

Relevant Facts emerged during Hearing:

The following were present:-

Appellant: Present through audio conference.

Respondent: Shri Sashi Bhushan, Dy. Director, appeared through video conference.

5. Proof of having served a copy of Second Appeal/Complaint on Respondent while filing the same in CIC on 01.10.2024 is available on record.

6. The Appellant inter alia submitted that information sought has not been provided by the Respondent till the date of hearing.

7. The Respondent, while defending their case, reiterated the reply furnished by the CPIO as well as the order passed by the FAA. The Respondent further submitted that the Directorate takes cognizance of matters only upon registration of an FIR or where sufficient material warranting investigation is available. It was also submitted that the Directorate of Enforcement is an exempt organization under Section 24 of the RTI Act read with the Second Schedule to the Act and, therefore, is not obliged to disclose the information sought under the RTI Act.

Decision:

The Commission after adverting to the facts and circumstances of the case, hearing both the parties and perusal of the records, observes that the Appellant is primarily aggrieved with the non-disclosure of information pertaining to the action taken on his complaint allegedly relating to disproportionate assets and corruption.
