Information sought:
1. The Appellant filed an RTI application dated 22.12.2024(offline) seeking
the following information:
“1.Calls details of Mobile No 9528449683 (Jio Company) for the Period w.e.f 1-
1-2021 to 31-12-2021

##PAGE2##2.Copy of Terms & Conditions under which the aforesaid company kept the data
under Preservation.”
2. The CPIO furnished a reply to the Appellant on 06.01.2025 stating as
under:
“I am directed to refer to your RTI application dated 22.12.2024 Under RTI Act,
2005 along with Postal Order of Rs.50/- received in this office and to say that
the said Postal Order bearing no. 92G 797002 is not acceptable in this office.
Under Right to Information Rules, 2012, the fee of Rs. 10/- is to be paid in the
form of Indian Postal Order/Bank Draft in the name of Pay & Accounts Officer
of the concerned department.
2. Therefore, you are requested to again send the RTI fee of Rs. 10/- in favour of
Pay & Accounts Officer, Department of Telecommunications payable at New
Delhi. Your RTI application along with Postal Order of Rs.50/- bearing no. 92G
797002 returned herewith.”
3. Being dissatisfied, the Appellant filed a First Appeal dated 18.02.2025. The
FAA order is not available on record.
4. Feeling aggrieved and dissatisfied, Appellant approached the Commission
with the instant Second Appeal.
Relevant Facts emerged during Hearing:
The following were present:-
Appellant: Absent.
Respondent: Shri Saurabh Chaturvedi, CPIO-cum-Director, attended the hearing
in person.
5. The Appellant did not participate in the hearing.
6. The Respondent submitted that initially the then CPIO vide letter dated
06.01.2025 has informed the Appellant to deposit the requisite fee for the
RTI Application. The Appellant thereafter deposited the requisite fee but
inadvertently no reply was given by the then CPIO with respect to the
instant RTI Application. Upon receipt of the hearing notice from the
Commission, a suitable reply has been given to the Appellant vide letter
dated 29.04.2026, which is as under:

##PAGE3##“Point No.1: Call details of mobile number 7248157598 (VI Comp) for the period
w.e.f 1-1-2021 to 31-12-2031.
Reply: The information sought is neither maintained nor available in the records
of this office. Furthermore, Call Detail Records (CDRs), Subscribers Data Records
(SDRs), live locations, etc., can only be sought from Telecom Service Providers
(TSPs) by designated Law Enforcement Agencies (LEAs) and can only be provided
to designated LEAs under the relevant statutory provisions. Further, CDRs are
also provided by TSPs to various Courts upon their specific orders/directions.
It is also pertinent to mention here that TSPs have been given licenses, for
provision of telecom service, under the provision of section 4 of Indian Telegraph
Act, 1885. Both TSPs and DoT are bound by the terms and conditions of the
License Agreement. However, the license does not mandate TSPs to provide Call
Detail Records (CDRs) or Subscriber Data Record (SDR) to DoT upon request by
the general public.
Further, the above stand of Department of Telecom (DoT) on RTI Requests
Seeking CDRs/SDRs, Live Location and Similar Information has also been upheld
by Hon'ble CIC in the following cases:
