Information sought:

1. Instant matter was earlier listed before the Commission on 16.04.2025 and the same was adjourned. The matter is listed today for further hearing.

2. The Appellant filed an RTI application dated 24-12-2022 seeking the following information:

“1. सड्ह रोड ेशन से मद बंदर ेशन के िबच म रेलवे टैक पे आपके सुरा कमचारी या टैक कमचारी ारा िदन म और रात म िकतने राउंड होते ह I

2. राउंड के पुरे िदन म समय ा तय है I

3. 30-05-2020 से 13-06-2020 तक सड्ह रोड ेशन से मद बंदर ेशन के िबच िकतनी बार और कौनसे कमचारी ारा राउंड आ उसकी आपके रिजर म िलखीत होगा उसकी ित िमले I

4. 13 -06 -2020 को मुंबई पुिलस ने सड्हरोड और मद बंदर ेशन के िबच के टैक के पास पोल . 1 /743 के पास िकस मृत की शरीर िमला है यह आपको सुचीत िकया है ा? अगर सुचीत कीया है तो उसकी लीखीत रिजर की त ा हो I”

3. The CPIO furnished a reply to the Appellant on 22-02-2023 stating as under:

“आपके ारा जन सूचना अिधकार अिधिनयम 2005 के तहत िकया गया आवेदन िदनांक 02.02.2023 को Online इस कायालय को ा आ, आरपीएफ मुंबई मंडल से संबंिधत मांगी गयी जानकारी िबंदुवार िननुसार है :-

िबंदु .1: इस िबंदु मे मांगी गयी जानकारी जन सूचना अिधकार अिधिनयम 2005 की धारा 8 (1) (g) व (h) के अनसार सुरा के ि से कट नहींकी जा सकती है।

िबंदु .2: इस िबंदु मे मांगी गयी जानकारी जन सूचना अिधकार अिधिनयम 2005 की धारा 8 (1) (g) व (h] के अनसार सुरा के ि से कट नहींकी जा सकती है।

िबंदु .3: इस िबंदु मे मांगी गयी जानकारी जन सूचना अिधकार अिधिनयम 2005 की धारा 8 (1) (g), (h) व (j) के अनसार सुरा के ि से कट नहींकी जा सकती है।

िबंदु .4: इस संबंध मे मुंबई पुिलस से इस कायालय को कोई जानकारी ा नहीं ई है।”

4. The Appellant filed a First Appeal dated 06-03-2023. The F.A.A vide order dated 24-04-2023 stating as under:

“आपके ारा आरटीआई मूल आवेदन के जरए सडह रोड तथा मद ेशनोंके बीच रेल पटरी पर सुरा रक या टैक कमचारीयोंारा िदन या रात को िकये जानेवाले ग से संबंिधत जानकारी माँगी थी। तदनुसार, Sr DEN/Co & PIO ने िद.13.03.2023 के प के माम से तथा Sr DSC/ RPF & PIO ने िद. 22.02.2023 के प के माम से आपको अपने अपने िवभाग से संबंिधत जानकरी दान की। िकु Sr DSC/RPF & PIO से ा जानकारी से सु ना होने के कारण आपने अधोहारी सेथम अपील िकया है।

इस िवषय म सुरा िवभाग से आाएँ माँगी गयी, िजसके उर मSr DSC/RPF & PIO ने सूिचत िकया िक उनके कायालय ारा आपको िद. 22.02.2023 के प के माम से जानकारी दी जानकारी सही है।

आपके आरटीआई आवेदन एवं थम अपील का अवलोकन िकया गया तथा Sr DEN/Co & PIO एवं Sr DSC/ RPF & PIO ारा दी गयी जानकारीयोंको भी परखा गया। आरपीएफ सुरा किमयोंकी ुटी एवं कायपित रेलवे के सुरा से संबंिधत होती ह। अतः , इस संबंध म उ िविभ खोंकी ग करनी पडती ह तथा औचक जाँच करनी पडती है, िजसकी सूचना अितगोपनीय रखी जाती है। अतः , Sr DSC /RPF & PIO ारा दान की गयी सूचना सही है तथा इस िवषय म कोई िनदश वांिछत नहींहै।”

5. Feeling aggrieved and dissatisfied, Appellant approached the Commission with the instant Second Appeal.

6. A written submission dated 09.04.2025 filed by Shri Rishi Kumar Shukla Sr. DSC/PIO, Commercial Branch, Central Mumbai is taken on record. Contents of the same are reproduced below for reference:

Second Appeal:-

1. The Appellant is accused in an offence registered as C.R.No.82/2020 of Dongari PS u/s 302, 201 IPC. And the information sought is crucial in preparing his defense.

II. The information sought relates to the duties of Railway employees during and at a relevant time and place wherein evidence relating to cognizable offence u/s 302 IPC was collected. And hence the same cannot be denied on grounds secrecy and safety of the Railways.

III. The reply of the C.P.I.O to point no.04 clearly reveals that the Mumbai Police did not receive any information from the office of the RPF, Mumbai, CSMT and hence it is even more necessary that the role of the Railway employees regarding the cognizable offence be looked into.

IV. In the alternative if disclosing the name of relevant Railway employees will cause harm to the safety of the Railw
