The Appellant filed an RTI application dated 13.06.2024 seeking information on following points:-

“1) Qualification and past working experience details (handling of sexual harassment cases, social work, legal work/knowledge, work done for cause of women) of all members.

2) All details about familiarity of all members of ICC, AR Site with the issues relating to sexual harassment.

3) Full detail about members from amongst non-governmental organisations or associations committed to the cause of women (in present ICC).

4) Experience details of all members of ICC, RR Site in the field of social work which leads to creation of societal conditions favourable towards empowerment of women and in particular in addressing workplace sexual harassment.

5) Complete details about familiarity of all members of ICC, IR Site with labour, service, civil or criminal laws.

6) Full detail about contravention of the provisions of Section-16 of the POSH Act-2013 by all/any members of present ICC.

7) Provide details w.r.t. all members of present ICC whether an inquiry into an offence under any law for the time being in force is pending against any member of ICC or any of them has been convicted for an offence anytime.

Etc.”

The CPIO vide letter dated 06.08.2024 replied as under:-

“Information received from the nodal agency is attached as Annexure-A (1 page).

Information received from the nodal agency is attached as Annexure-B (1 page).

Nodal agency informed the dates of training are 19/12/2023, 23/08/2023 to 24/08/2023. Further details are exempted under”

Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 08.08.2024. The FAA, ED (CP&CC), NPCIL vide order dated 30.08.2024 stated as under:-

“The response of CPIO is in order w.r.t. Point nos. 1 to 8 & 11. With reference to Point No. 9, no information is available. In respect of Point no. 10, all the members of ICC have attended training conducted on

23rd and 24th August, 2023.”

Aggrieved and dissatisfied, the Appellant approached the Commission with the instant Second Appeal.
