The Appellant filed an RTI application dated 25.04.2024 seeking information on the following points:-

1. “Whether M/s MARIOT HOLIDAYS INN & SUITES PVT LTD. having its Corporate Office at D3 BASEMENT KALKAJI NEW DELHI 110019 registered under Companies Act?

2. If answer to the above question is affirmative, please provide its registration number, name of current directors with their complete personal address and phone/mobile numbers.”

The CPIO, Registrar of Companies, Delhi and Haryana vide letter dated 16.05.2024 replied as under:-

“PARA 1 & 2 All information pertaining to any Company registered on MCA (after year 2006) are already on public domain as part of service provided to all stakeholders and may be accessed from the MCA website online.

For knowing all basic details like present status, CIN, registered address & e-mail address, etc. of any registered company on MCA 21 portal, you may refer Master data of which are already available in public domain as part of service provided to all stakeholders and may be accessed from the MCA website as under:

www.mca.gov.in MCA Services Master Data Master Data Services V3 Company or LLP Master Data View For knowing details about present directors of any registered Company on MCA-21 portal, you may refer signatory details of the Company which is already available on public domain as part of service provided to all stakeholders which may be accessed from the MCA website as under:

www.mca.gov.in MCA Services Master Data- View Signatory Details.

To access any electronically filed documents / e-forms filed by any company you may visit MCA website, www.mca.gov.in, go to MCA21 SERVICES link, register yourself as a REGISTERED USER and view public documents which are available for public viewing after payment of requisite fee You may use the GET CERTIFIED COPIES link under MCA SERVICES available on the website for obtaining certified copies after payment of requisite fee.

Please note that CPIO is obliged to provide only that information which is available to him/her pursuant to section 2(f) of RTI Act, 2005 and accessible under section 2 (j) of RTI Act, 2005. Please note that the information, which is available in public domain, cannot be treated as information accessible under section 2(j) of RTI Act

2005.”

Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 17.05.2024. The FAA vide order dated 11.06.2024 held as under:-

“On perusal of this office record it has been observed that CPIO had already forwarded her reply to the appellant/RTI applicant on 16.05.2024 which is within the time limit as prescribed in RTI Act, 2005 and the reply of the CPIO appears correct in spirit of law i.e. RTI Act, 2005. Further, w.r.t. information sought in para 2 of the RTI Application i.e. complete personal address and phone/ mobile numbers of the current directors, CPIO is directed to re examine the matter and suitable reply may be provided to the appellant as per RTI Act, 2005.”

In compliance of the FAA’s Order, Asstt. Registrar of Companies & CPIO, Registrar of Companies, Delhi and Haryana vide letter dated 19.06.2024 stated as under:-
