Information sought:

1. The Appellant filed an RTI application dated 01.02.2025(online) seeking

the following information:

“I purchased a bike in 2018 from Maharashtra (MH) state and registered in

MH12 RTO. HSRP number plate was not in force during 2018 due to which a

normal whiteboard number plate was affixed.

Once the HSRP rule was brought into legal effect in 2019, many other states

RTOs initiated issuing HSRP through online services

https://bookmyhsrp.com/index.aspx in which the HSRP for vehicles registered

in any state before 2019 can be affixed in any current residing state where the

vehicle is physically present but Maharashtra RTO did not start online service at

that time.

Now that Maharashtra state has also started a separate online service

https://www.mhhsrp.com/index.aspx to issue HSRP for vehicles in which they

are issuing HSRP to vehicles plying only within Maharashtra. There is no option

for the citizens who have registered their vehicle in MH and are currently

residing outside the state nor is there a delivery option outside Maharashtra to

get the HSRP affixed without bringing the vehicle into MH. This becomes very

difficult for the citizens who are residing outside MH due to their job profile

(especially government officials) and want to affix HSRP in their vehicle to avoid

unnecessary challans by the traffic regulatory authority.

I am one such citizen working in a private organization, posted in Haryana owing

to job requirements because of which I am unable to take my bike to MH which

is very far from Haryana for HSRP affixation.

Kindly confirm if there is any rule that allows MH vehicles to get the HSRP affixed

anywhere at their owners current residing state, unlike other state RTOS or if

there is any rule to avoid challans for not affixing HSRP due to the lack of services

from Maharashtra RTO/until this issue is sorted by Maharashtra RTO.”

2. The CPIO furnished a reply to the Appellant on 11.02.2025 stating as

under:

“The undersigned is dealing with Central Motor Vehicles Rules, 1989 (CMVRs)

and Motor Vehicles Act, 1988 (MV Act). The MV Act and CMVRs are available

on this Ministry's website www.morth.nic.in. With reference to your queries it is

stated that Rule 50 of Central Motor Vehicles Rules, 1989 contains the provision

relating to Form and manner of display of registration marks on the motor

vehicles. Further, this Ministry vide Letter No.RT-11036/99/2020-MVL, dated

09/06/2023, 29/12/2023 & 08/01/2024 (copies enclosed) has issued an

advisory on clarification on affixation of High Security Registration Plates on

motor vehicle plates on new vehicles as well as existing old vehicles.

Implementation of provisions of Motor Vehicles Act, 1988 and Central Motor

Vehicles Rule, 1989 including Registration of Vehicle comes under the purview

of concerned authority of State/UTs. However, your RTI application is

transferred to the Transport Commissioner, Government Maharashtra, under

Section 6(3) of the RTI act to provide the information available with them and

necessary action in this regards.”

3. Being dissatisfied, the Appellant filed a First Appeal dated 22.03.2025. The
