O R D E R

1. The Appellant filed an RTI application dated 27.07.2024, before the CPIO,

Directorate of Health Services (DHS), Jammu, UT of J & K, seeking information as under:

“1. Kindly provide official records in connection with treatment of Patient vide

prescription slip no. 65998 & Patient registration number (Patient ID) 2385 dated 21-05-

2024.

2. Please give reasons that why computerized prescription/slip was not issued at the

time of registration/follow-up on dated: 21.05.2024, 01.06.2024, 13.-06-2024 and 29-06-

2024 to the above-mentioned patient.

3. Please provide the records of base line investigations (CBC, RFT, X-ray Lumbo-

Sacral spine etc.) advised/performed by hospital before advising MRI Lumbo-Sacral Spine

to the above-mentioned patient.

4. Since the patient was suffering from Lower back pain & is supposed to consult

Orthopedics Surgeon, why he repeatedly consulted General Surgeon on every visit?

5. Please provide registration number wise name of each patient registered

electronically (Computerised record) and manually who visited SDH Bishnah on

21.05.2024, 01.06.2024, 13.-06-2024 and 29-06-2024 for treatment.

6. Kindly provide the copies of Morning, Evening and Night Duty roaster including

that of consultants on call for the month of May, June and July 2024.”

2. The CPIO & Controller of Stores (H), DHS, Jammu sent a letter dated 02.08.2024

to the Block Medical Officer & APIO, Bishnah stating as under:

“The application under RTI filed by Smt. Neelam Gorka is forwarded to you with

direction to furnish the requisite information to this office within a week's time positively.

It may be ensured that while furnishing the requisite information such points/ information

may not be responded which is personal in nature and has nothing to do with the public

interest/activity and will cause unwarranted invasion in the privacy of the individual.”

3. Further, reminders dated 13.08.2024; 23.08.2024; 12.09.2024 were also sent to the

Block Medical Officer & APIO, Bishnah in this regard.

4. Aggrieved with the non-receipt of any information, the Appellant filed a First

Appeal dated 07.09.2024.

5. Further, upon not receiving any information or response, the Appellant approached

the Commission with the instant Second Appeal on 27.10.2024.

Hearing Proceedings & Decision

6. The Appellant remained absent during the hearing. On behalf of the Respondent,

Dr. Ratesh Khullar, Controller of Stores (H) & CPIO attended the hearing through video

conference.

7. The Respondent relied on the undated written submissions filed in response to the

notice of registration of second appeal dated 14.01.2026, sent by the Central Registry of

CIC, stating as under:

“2. That the RTI Application dated 27-07-2024 was received in the office of the

answering respondent on 30-07-2024, wherein the appellant had sought information

under six (06) distinct points.

3. That it is respectfully submitted that the information/record sought by the

appellant primarily pertained to Sub District Hospital, Bishnah, which does not fall within

the direct custodianship of the answering respondent. Accordingly, the answering

respondent vide letter No. DHSJ/PIO/5223-24, dated 02-08-2024 called upon the Block

Medical Officer, Bishnah (APIO) to furnish the requisite point-wise information, with
