The Complainant filed an RTI application dated 07.11.2023 seeking information on the following points:-

1. Kindly furnish necessary all relevant information (including office address, office contact phone number and office Email ID) to applicant about particular forum for lodging complaint against members of "Sexual Harassment committee" for seriously violating to Firstly, "The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act (2013)" and Secondly, "The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules (2013)"

respectively.

2. Kindly furnish all necessary information about all relevant provisions of "The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act (2013)" regarding lodging complaint against members of Sexual Harassment committee for its violation.

3. Kindly furnish all necessary information about all relevant provisions of "The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules (2013)" regarding lodging complaint against members of Sexual Harassment committee for its violation.

4. Kindly furnish necessary information about office address, phone number and email ID of concerned authority/ministry who has power to make amendment in Firstly, "The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act (2013)" and Secondly, "The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules (2013)" respectively.

Note: Payment of Rs. 10.00 is being paid by applicant through Original Crossed IPO No. 57F498126 Dated 25.11.2022 in favor of "Account Officer, MHA GOI, New Delhi" as RTI Fee for this RTI Application for obtaining all required public documents. In case of need for additional fee, the applicant may be informed so that the balance amount can be deposited by the applicant. The applicant also requests that a soft copy of the response be furnished him through Email to his Email ID rkg.vh2014@gmail.com in the interest of expediency.”

Having not received any response from the CPIO, the Complainant filed a First Appeal dated 08.12.2023.

Meanwhile, the CPIO, Ministry of Home Affairs, New Delhi vide letter dated

09.12.2023 replied as under:-

“……………it is informed that the information sought by you is not held by the undersigned CPIO. Therefore, your application is being transferred to the concerned CPIO in Ministry of Women & Child Development, under Section 6(3) of RTI Act, 2005 for providing the information directly to you.”

In regard to his first appeal, the FAA vide order dated 28.12.2023 upheld the reply of CPIO.

Aggrieved and dissatisfied, the Complainant approached the Commission with the instant Complaint.

Facts emerging in Course of Hearing:

A written submission dated 05.03.2025 has been received from CPIO, Ministry of Women and Child Development, Women Welfare-I Division stating as under:

2. From the documents retrieved, it has been found that the RTI application dated 07.11.2023 was received by this Ministry and a reply was furnished to the applicant vide this Ministry's letter of even number dated 14.12.2023 (copy enclosed). There was no additional information available with the CPIO.
